WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality located
in Lubbock County, Texas, has determined and does hereby determine that the
public needs, safety and welfare demand and create a public necessity for
the acquisition of additional land for municipal public uses and purposes,
to -wit: for the widening of 34th Street, and this City Council of said City
finds it in the public interest and for public purposes and municipal
purposes to proceed with the acquisition of lands as needed for such
purposes as aforesaid; NOW THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the fee simple title to the following described tract
of land located in Lubbock County, Texas, be acquired for public purposes
and municipal purposes as set forth in the preamble hereof, to -wit:
FIELD NOTE DESCRIPTION on a 128,704 square feet tract of land
out of Tract No. 12, Lowery Subdivision to the City of Lubbock,
and being out of Sections 37 and 38, Block A-K, Lubbock County,
Texas and being more particularly described as follows:
BEGINNING at a R.R. spike found at the Northeast corner of said
Section 38, for the beginning point of this tract;
THENCE South 87035,27" East, along the North line of said
Section 37, 169.08 feet to a R.R. spike, set for the Northeast
corner of this tract;
THENCE South 02°20138" West, 622.41 feet to a 1/2" iron rod,
found for a corner of this tract;
THENCE South 02023,57" West, 306.13 feet to a 1/2" iron rod, set
for a corner of this tract;
THENCE South 02022146" West, 62.52 feet to a 1/2" iron rod, set
for the Southeast corner of this tract;
THENCE North 87037,13" West, 55.00 feet to a 1/2" iron rod, set
for the Southwest corner of this tract;
THENCE Northwesterly, along the arc of a curve to the left, an
arc distance of 119.41 feet to a set 1/2" iron rod, said curve
has a radius of 1190.00 feet, a central angle of 05°44158",
tangent lengths of 59.76 feet, and a chord that bears North

THENCE North 03022,11" West, 773.84 feet to a 1/2" iron rod, set
for the P.C. of a curve to the left;
THENCE Northwesterly, along the arc of said curve, an arc
distance of 44.13 feet to a set 1/2" iron rod, said curve has a
radius of 30.00 feet, a central angle of 84016,34", tangent
lengths of 27.14 feet and a chord that bears North 45*30,28"
West, 40.26 feet;
THENCE North 87°38'45" West, 208.00 feet to a 1/2" iron rod, set
for a corner of this tract;
THENCE North 81056,07" West, 201.00 feet to a 1/2" iron rod, set
for a corner of this tract;
THENCE North 02021,15" East, 55.00 feet to a R.R. spike, set in
the North line of Section 38, for the Northwest corner of this
tract;
THENCE South 87038,45" East, along the North line of said
Section 38, 407.04 feet to the POINT OF BEGINNING.
CONTAINING: 128,704 square feet. (2.955 Acres)
SECTION 2. THAT the owners of said tract, including Hilbert Kyle
Seale, Daniel K. Seale, Kathleen L. Seale Withers, Carolyn A. Seale, Stephen
M. Seale, Victoria L. Seale, and Marian E. Seale Freeland, BE offered
through the Right -of -Way Department of the City of Lubbock the amount of
$29,550.00, which is the amount appraised as the value and total damages for
the fee simple title and acquisition of said real estate hereinabove
described, for the use and benefit of the City of Lubbock, Texas, for the
purposes herein stated, and unless accepted forthwith, the City Attorney of
said City of Lubbock is hereby authorized and instructed to institute
condemnation (eminent domain) proceedings to acquire the fee simple title to
said land as hereinabove described for public purposes and municipal
purposes.
