WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality located
in Lubbock County, Texas, has determined and does hereby determine that the
public needs, safety and welfare demand and create a public necessity for
the acquisition of additional land for municipal public uses and purposes,
to -wit: for the widening of 34th Street, and this City Council of said City
finds it in the public interest and for public purposes and municipal
purposes to proceed with the acquisition of lands as needed for such
purposes as aforesaid; NOW THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the fee simple title to the following described tract
of land located in Lubbock County, Texas, be acquired for public purposes
and municipal purposes as set forth in the preamble hereof, to -wit:
FIELD NOTE DESCRIPTION on a 10,028 square feet tract of land out
of Lots 137 through 141, West Side Addition to the City of
Lubbock, and being out of Section 44, Block A-K, Lubbock County,
Texas, and being more particularly described as follows:
BEGINNING at a 3/4" iron pipe found at the Northwest corner of
said Lot 137 for the Northwest and beginning corner of this
tract, whence a R.R. spike found at the Southwest corner of
Section 44 bears North 87039,47" West, 60.14 feet and South
02020113" West, 169.13 feet;
THENCE South 87°38,42" East, along the North line of said Lot
137, 54.09 feet to a 1/2" iron rod, set for a corner of this
tract;
THENCE South 03022,11" East, 87.52 feet to a 1/2" iron rod set
for the P.C. of a curve to the left;
THENCE Southeasterly, along the arc of said curve, an arc
distance of 44.14 feet to a set 1/2" iron rod, said curve has a
radius of 30.00 feet, a central angle of 84018,19", tangent
lengths of 27.16 feet, and a chord that bears South 45031,21"
East, 40.27 feet;
THENCE South 87*40131" East, 208.00 feet to a 1/2" iron rod set
for a corner of this tract;
THENCE South 84048,46" East, 9.33 feet to a 1/2" iron rod set in
the East line of Lot 141, for a corner of this tract;
THENCE South 02023,31" West, along the East line of said Lot
141, 9.53 feet to a 1/2" iron rod set at the Southeast corner of
Lot 141 for the Southeast corner of this tract;
THENCE North 87°40'31" West, 295.00 feet to a 1/2" iron rod, set
for the P.C. of a curve to the right;
THENCE Northwesterly, along the arc of said curve, an arc
distance of 23.57 feet to a set 1/2" iron rod, said curve has a
radius of 15.00 feet, a central angle of 90°02107", tangent
lengths of 15.01 feet, and a chord that bears North 42°39'27"
West, 21.22 feet;
THENCE North 02021,36" East, along the West line of said Lot
137, 109.13 feet to the POINT OF BEGINNING.
CONTAINING: 10,028 square feet. (0.230).
SECTION 2. THAT the owner of said tract, Frank D. Wilson, BE offered
through the Right -of -Way Department of the City of Lubbock the amount of
$11,423.00, which is the amount appraised as the value and total damages for
the fee simple title and acquisition of said real estate hereinabove
described, for the use and benefit of the City of Lubbock, Texas, for the
purposes herein stated, and unless accepted forthwith, the City Attorney of
said City of Lubbock is hereby authorized and instructed to institute
condemnation (eminent domain) proceedings to acquire the fee simple title to
said land as hereinabove described for public purposes and municipal
purposes.
