RESOLUTION
WHEREAS, the City of Council of the City of Lubbock finds that an
easement title to land hereinafter described is needed by said City for
municipal purposes and public purposes: a permanent easement over, upon,
under, along, and across said land for the construction, reconstruction,
operation, and maintenance of a sanitary sewer line as an integral part of
the sewage system of the City of Lubbock, and ingress, regress and egress in
and to said land for such purposes; NOW THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the Right -of -Way Department of the City of Lubbock is
hereby authorized and directed to make an offer on behalf of the City of
Lubbock in the amount of $15,000.00 to C. E. Holeman, W. A. Holeman a/k/a W.
Alfred Holeman, and Clellie C. Holeman, as owners, for the purchase by the
City of Lubbock of a permanent easement title to be used for municipal
purposes and public purposes as set forth in the preamble hereof and
described as follows:
A Permanent Sanitary Sewer Line easement more particularly
described as follows:
Permanent easement thirty feet in width, being fifteen feet on
each side of and parallel to the following described center
line:
BEGINNING at a point being 85.60 feet east of the Southwest
corner of the Southeast 1/4 of Section 2, Block "B", Lubbock
County, Texas;
THENCE North 33*10' East, 293.60 feet to a point;
THENCE North 86025, East, 400.00 feet to a point;
THENCE South 56°55' East, 137.55 feet to a point;
THENCE South 45005, East, 277.73 feet to a point in the South
section line of Section 2, Block "B". Said point bears East
956.76 feet from the Southwest corner of the Southeast 1/4 of
Section 2, Block "B", Lubbock County, Texas.
SECTION 2. THAT if said offer is not accepted forthwith, the City
Attorney of said City of Lubbock is hereby authorized and instructed to
institute condemnation (eminent domain) proceedings to acquire the permanent
easement title to said land as hereinabove described for said municipal
purposes and public purposes.
