RESOLUTION
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LUBBOCK, TEXAS, TO
EXERCISE ITS OPTION TO TAX THAT PROPERTY EXEMPTED FROM TAXATION UNDER SEC-
TION 11.251, TEXAS PROPERTY TAX CODE, AND ARTICLE 8, SECTION 1-j, TEXAS
CONSTITUTION.
WHEREAS, Article 8, Section 1-j, Subsection (a), of the Texas Con-
stitution and Section 11.251 of the Texas Property Tax Code exempts from
taxation certain tangible personal property referred to as "freeport goods"
unless the governing body of the taxing authority elects to tax such prop-
erty; and
WHEREAS, the exemption of said "freeport goods" from taxation by the
City of Lubbock, Texas, would result in the loss of needed revenues to the
City and an unfair shift of the tax burden to the homeowner and local busi-
nessman; and
WHEREAS, Article 8, Section 1-j, Subsection (b), of the Texas Con-
stitution authorizes the City Council of the City of Lubbock, Texas, to
exercise its option to tax said "freeport goods"; NOW THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the City of Lubbock hereby elects to tax that tangible personal
property described in Article 8, Section 1-j, Subsection (a), Texas Consti-
tution, and Section 11.251, Texas Property Tax Code, which would otherwise
be exempt.
Passed by the City Council on this 7th day of December
1989.

ROBERT -- WOULD YOU BE SURE THAT THE SIGNED RESOLUTION WHEREBY WE
WANT TO CONTINUE TAXING THE PROPERTY PROVIDED FOR IN THE FREEPORT
LAW I% SUBMITTED TO THE APPRAISAL DISTRICT. I CERTAINLY FEEL
THAT BECAUSE OF THE IMPORTANCE OV THIS THAT WE GET SOME KIND OF
WRITTEN ACKNOWLEDGEMENT FROM THE APPRAISAL DISTRICT THAT THEY
HAVE RECEIVED OUR RESOLUTION TO CONTINUE TAXING THIS PROPERTY. I
WOULD CERTAINLY HATE FOR OUR RESOLUTION TO GET LOST IN THE
SHUFFLE AT THE APPRAISAL DISTRICT AND THEN FIND THAT WE'VE LOST
030 MILLION IN TAX BASE. WOULD YOU PLEASE SEE THAT THEY GET U%
SOME KIND OF ACKNOWLEDGEMENT THAT THEY WILL CONTINUE TAXING THE
PROPERTY.
I WILL APPRECIATE YOUR FOLLOWING UP ON THIS MATTER.
