HomeMy WebLinkAboutResolution - 021369G - Paving Release - Pioneer Pavers Inc - 66Th Street - 02_13_1969�tt3 ' RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock be and is hereby authorized and directed to execute for and on behalf of the City of Lubbock a Paving Release, attached herewith which shall be spread upon the minutes of the Council and as spread upon the minutes of this Council shall constitute and be a part of this Resolution as if fully copied herein in detail. APPROVED: nter, Jr.,/qAy Attor THE STATE OF TEXAS I COUNTY OF LUBBOCK I KNOW ALL MEN BY THESE PRESENTS: PAVING RELEASE WHEREAS, heretofore, on March 31, 1966, the City of Lubbock passed Ordinance No. 4970, such being recorded in Volume 1081, Page 113 of the Deed Records of Lubbock County, Texas, such ordinance containing a notice of improvements and apportionment of costs of such improvements by assessing a lien against the property abutting thereon, and WHEREAS, the apportioned costs of one certain assessment and improvements have been placed in an escrow account by the owners of the abutting property pending completion of the actual improvements, and it is expedient to remove the cloud and lien upon such property, NOW THEREFORE, the City of Lubbock and Pioneer Pavers Incorporated, acting by and through their officers heretofore duly authorized, in consideration of the premises, do hereby and by these presents, RELEASE, RELINQUISH, and FOREVER QUIT CLAIM to the owner or owners of property affected by the paving assessment liens hereinabove mentioned, their heirs, administrators, executors and assigns, all right, title and interest the City of Lubbock and Pioneer Pavers Incorporated may have in and to all these lots, tracts or parcels of land being situated in the City of Lubbock, Lubbock County, Texas, and being further described as follows, to -wit: Unit 2146-5 The North 'z of 66th Street from 15. 0 feet West of the W. P. L. of Indiana Avenue to 15. 0 feet East of the E. P. L. of 66th Drive, being more particularly described as follows: Beginning at a point 55. 0 feet West and 30. 0 feet North of the Southeast corner of Section 8, Block E-2, Lubbock County, Texas; Thence West 497.99 feet; Thence North 150. 0 feet; Thence East 497.99 feet; Thence South 150. 0 feet to the point of beginning. This Release affects only the property hereinabove described and in no way affects any property or liens not specifically described herein, and all liens and apparent liens against property owners not otherwise released are hereby expressly retained.
