HomeMy WebLinkAboutResolution - 3160 - Commitment To Provide Infrastructure For A Texas State Prison - 07_27_1989Resolution #311 July 27,"1989 Item #7 JCR:da RESOLUTION WHEREAS, the City of Lubbock is making application to the Texas Department of Corrections for the construction of a new prison facility to be located within the City; and WHEREAS, the construction of such a facility will greatly enhance the capabilities of the criminal justice system operated within the City; and WHEREAS, the existence of such a facility will also act as a deterrent for crime within the City; and WHEREAS, the construction of such a facility will further benefit the City of Lubbock by providing and enhancing economic opportunities for the City and its citizens; and WHEREAS, the construction of such a facility will also provide additional jobs within the community; and WHEREAS, the City Council finds that it is a public purpose and in the best interest of the citizens of this community that such facil- ity be constructed; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the City hereby commits up to $633,000.00 of available funds currently on hand for the construction and establish- ment of water, sewer and electric utility lines for the purpose of providing such public services to the Texas Department of Corrections in connection the construction, operation and maintenance of the new prison facility to be located within the City. SECTION 2. THAT the City as owner of one half (1/2) of the mineral interests on 510.695 acres of land out of Section 41, Block A, Lubbock County, Texas, agrees that if the Texas Department of Corrections constructs a prison facility upon the East 310 acres out of Section 41, Block A, Lubbock County, Texas, which acreage has been identified as a possible prison site, that City will not engage in or undertake any surface development on the 310 acres nor shall City undertake the drilling of any oil, gas well or water well upon the 310 acres above described.
