RESOLUTION
WHEREAS, the City Council of the City of Lubbock has heretofore deter
mined and now finds that the surface drainage facilities near Quaker Avenue and
Brownfield Highway in the City of Lubbock are presently inadequate and it is
necessary to additionally open and widen the existing draining channel; and
WHEREAS, it is necessary to acquire for surface drainage purposes
the fee simple title to the land hereafter described, owned by Charlie S. William
and wife, Idell Williams; and
WHEREAS, the Council has caused an appraisal to be made of said land
and the value and total damages, if any, to the owners, and all others, whose
interest may appear, for fee simple title to said land have been appraised in the
amount of $12, 588. 00, and the Council finds such amount to be fair and equitable;
NOW THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the City of Lubbock acquire for the purpose of opening and widen-
ing the existing drainage channel near Quaker Avenue and the Brownfield Highway
the fee simple title to the following described property lying and being situated
in Lubbock County, Texas, and more particularly described as follows, to -wit:
BEGINNING at the Southeast corner of Lot 5, Block 4,
John W. Jarrott Subdivision of the Northwest 4 of Section
15, Block B, Lubbock County, Texas;
THENCE North along the East line of said Lot 5 a distance
of 34. 71 feet to a point;
THENCE Northwesterly, parallel to and 30. 0 feet
Northeast from the Southwest line of Lots 5, 1 and 2
of said Block 4, a distance of 126. 15 feet to a point,
said point being the beginning of a curve to the right,
the center of said curve being North 30 ° 11' 30" East
100. 0 feet from said point;
THENCE Northwesterly along said curve to the right,
said curve having a radius of 100. 0 feet, f tangents of
57.51 feet and delta angle of 59°4813011, a distance of
104. 39 feet to the end of said curve; 41
THENCE North, parallel to and 30. 0 feet East of the
West line of Lot 2 of said Block 4, a distance of 172.72
feet to a point;
THENCE North 35 *57' West a distance of 19.47 feet
to a point on the Northwest line of said Lot 2;
THENCE Southwesterly along the Northwest line of
said Lot 2 a distance of 22. 94 feet to the Northwest
corner of said Lot 2;
THENCE South along the West line of said Lot 2 a
distance of 249.78 feet to the Southwest corner of
said Lot 2;
THENCE Southeasterly along the Southwest lines of
Lots 2, 1 and 5, a distance of 218. 37 feet to the POINT
OF BEGINNING.
THAT Charlie S. Williams and wife, Idell Williams, and all others, if
any, whose interests may appear, be offered through the Right -cif -Way
Department, the amount appraised as the value and total damages, if any, for
the fee simple and acquisition of said land for the purposes herein stated, for
the use and benefit of the City of Lubbock, and unless accepted forthwith, the
City Attorney is hereby authorized and instructed to institute condemnation pro-
ceeding for and on behalf of the City of Lubbock to acquire the fee simple title
to said land as hereinabove described for surface drainage purposes.
Approved and passed by unanimous vote of the Council this
of January 1969.
