HomeMy WebLinkAboutResolution - 012369E - Join Paving Release - Kerr Construction Co - 54Th Street - 01_23_1969E IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock be and is hereby authorized and directed to execute for and on behalf of the City of Lubbock a joint paving release with Kerr Construction Company, attached herewith which shall be spread upon the minutes of the Council and as spread upon the minutes of this Council shall constitute and be a part of this Resolution as if fully copied herein in detail. Passed by the City Council this 23rd day of January 196 ATTEST Lowe, City Secretary -Treasurer In THE STATE OF TEXAS I PAVING RELEASE COUNTY OF LUBBOCK I WHEREAS, heretofore, on January 25, 1968, the City of Lubbock passed Ordinance No. 5388, such instrument being recorded in Volume 1155, Page 253, of the Deed Records of Lubbock County, Texas, such Ordinance containing a notice of improvements and apportionment of costs of such improvements by assessing a lien upon the property abutting hereon, and in such Ordinance there was included paving assessments for certain hereinafter described paving units or leave -outs; and WHEREAS, under such paving sub -units or leave -outs, such improvements have created no lien or liens against the property assessed pursuant to said paving sub -units or leave -outs; and it is expedient to remove the cloud and apparent lien placed upon the title of property abutting the street as aforemention; NOW THEREFORE: KNOW ALL MEN BY THESE PRESENTS: THAT the City of Lubbock and Pioneer Pavers, Inc., acting by and through their officers heretofore duly authorized in consideration of the premises do hereby and by these presents, RELEASE, RELINQUISH AND FOREVER QUITCLAIM to the owner or owners of property affected by the paving assessment liens hereinabove mentioned, their heirs, administrators, executors and assigns, all right, title and interest the City of Lubbock 4nd Pioneer Pavers, Inc, may have in and to all these lots, tracts or parcels of land being situated in the City of Lubbock, Lubbock County, Texas, and being further described as follows, to -wit: Part of Unit 54th Street from 410 feet East of the EPL of Memphis 2180-28 Avenue to 8 feet West of the WPL of Kenosha Avenue.
