RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock be and is hereby authorized and, 'r
directed to execute for and on behalf of the City of Lubbock a joint paving release
with Pioneer Pavers, Inc., attached herewith which shall be spread upon the
minutes of the Council and as spread upon the minutes of this Council shall
constitute and be a part of this Resolution as if fully copied herein in detail.

PAVING RELEASE
COUNTY OF LUBBOCK Jj
WHEREAS, heretofore, on January 25, 1968, the City of Lubbock passed
Ordinance No. 5389, such instrument being recorded in Volume 1155, page 322 of
the Deed Records of Lubbock County, Texas, Such Ordinance containing a notice
of improvements and apportionment of costs of such improvements, by assessing
a lien upon the property abutting hereon, and in such Ordinance there was included
paving assessments for certain hereinafter described paving sub -units or leave -
outs; and
WHEREAS, under such paving sub -units or leave -outs, such improve-
ments have created no lien or liens against the property assessed pursuant tZd
said paving sub -units or leave -outs, and it is expedient to remove the cloud
apparent lien placed upon the title of property abutting the street as aforemen-
tioned; NOW THEREFORE,
KNOW ALL MEN BY THESE PRESENTS:
THAT the City of Lubbock acting by and through their officers heretofore
duly authorized in consideration of the premises do hereby and by these presents,
RELEASE, RELINQUISH AND FOREVER QUITCLAIM to the owner or owners of
property affected by the paving assessment liens hereinabove mentioned, their
heirs, administrators, executors and assigns, all right, title and interest the
City of Lubbock may have in and to all these lots, tracts or parcels of land being
situated in the City of Lubbock, Lubbock County, Texas, and being further des-
cribed as follows, to -wit:
Sub -unit The east -west alley between 25th Street and 26th Street from
26 of unit its intersection with a line 12 feet West of the East property
A-394 line of Canton Avenue to its intersection with a line 14 feet
East of the West property line of Boston Avenue, known and
designated as sub -unit Number 26 of Unit No. A-394, (Lots
1, 2, 3, 4, 5 and 6 of Block 6, Del Mar Addition are excepted
from assessment).
This Release affects only the property hereinabove described and in no
way affects any property or liens not specifically described herein, and all liens
and apparent liens against property owners not otherwise released are hereby
expressly retained.

PAVING RELEASE
WHEREAS, heretofore, on the loth day of November, 1966, the City of
Lubbock passed a Notice of intent of Paving Assessments, such being recorded
in Volume 459, Page 437 of the Deed Records of Lubbock County, Texas, and on
February 9, 1967 passed Ordinance No. 5185 which instrument was not recorded
but which contained a notice of improvements and apportionment of costs of such
improvements, by assessing a lien upon the property abutting hereon, and in
such Ordinance there was included paving assessments for certain hereinafter
described Paving Sub -Units or Leave -outs; NOW, THEREFORE,
KNOW ALL MEN BY THESE PRESENTS:
THAT the City of Lubbock and Kerr Construction Company, acting by
and through their officers heretofore duly authorized in consideration of the
premises, do hereby and by these presents, RELEASE, RELINQUISH and
FOREVER QUITCLAIM to the owner or owners of property affected by the
paving assessment liens hereinabove mentioned, their heirs, administrators,
executors and assigns, all right, title and interest the City of Lubbock and
Kerr Construction Company may have in and to all these lots, tracts or parcels
of land being situated in the City of Lubbock, Lubbock County, Texas, and
being further described as follows, to -wit:
Unit 2159-8 East 7th Street from 6 feet West of the WPL of Walnut
Avenue to 8 feet East of the EPL of Ute Avenue.

Unit 2159-17 46th Street from 17 feet West of the EPL of Avenue D
to 23 feet East of the EPL of Avenue C (South Leg)
Part of Unit 66th Street from 15 feet East of the EPL of Indiana
2163-1 Avenue to 13 feet West of the WPL of Gary Avenue. The
below described tracts only to be released.
BEGINNING at a point 55. 00 feet East and 45 feet North
of the Southwest corner of Section 7, Block E-2, Lubbock
County, Texas; Thence East parallel to the section line
605. 00 feet; Thence North 150. 00 feet; Thence West
605. 00 feet; Thence South 150. 00 feet to the POINT OF
BEGINNING.
BEGINNING at a point 45. 00 feet North and 660. 00 feet
East of the Southwest corner of Section 7, Block E-2,
Lubbock County, Texas; Thence East parallel to the
section line 330. 00 feet; Thence North 150. 00 feet;
Thence West 330. 00 feet; Thence South 150. 00 feet to the
POINT OF BEGINNING.
BEGINNING at a point 45. 00 feet North and 990. 00 feet
East of the Southwest corner of Section 7, Block E-2,
Lubbock County, Texas; Thence East parallel to the
section line 330. 00 feet; Thence North 150. 00 feet;
Thence West 300. 00 feet; Thence South 150. 00 feet to
the POINT OF BEGINNING.
Part of Unit
2164-1 North Gary Avenue from 13.50 feet North of the
N. P. L. of Oberlin Street (West Leg) to 12 feet
South of the N. P. L. of Clovis Road. The below
described assessment only to be released.
Roadbeds, ties, rails and other appurtenances
between the rails and two (2) feet either side
thereof.
This Release affects only the property hereinabove described and in
no way affects any property or liens not specifically described herein, and all
liens and apparent liens against property owners not otherwise released are
hereby expressly retained.
