HomeMy WebLinkAboutResolution - 102468A - Street Improvements - City Engineer - Avenue A - 10_24_1968RESOLUTION WHEREAS, the City Council of the City of Lubbock by resolutions passed on September 12, 1968 and September 24, 1968, at regular sessions of said City Council declared a necessity for and ordered the improvement of those certain highways or portions thereof including alleys in the City of Lubbock, Lubbock, Texas, as more particularly described hereafter, by excavating, grading, and paving the same and by the construction of drainage facilities therein and by the construction of curbs and gutters wherein curbs and gutters are not now in place, and directing the City Engineer to prepare plans and specifications for said improvements; and, WHEREAS, the plans and specifications for the improvements of said high- ways and alleys have now been duly approved by the City Council of the City of Lubbock, Lubbock, Texas, WHEREAS, it appears to the City Council of the City of Lubbock, Lubbock Texas to be necessary in the public interest to make the improvements herein designated on those certain highways, public streets and alleys or portions thereof NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT improving the hereinafter described highways and alleys, or portions thereof, located within the City of Lubbock by excavating, grading, and paving the surface thereof and the construction of drainage facilities therein as well as the necessary curbs and gutters which are not now in place be and are hereby found to be a necessity, on the following highway, alleys or portions thereof to be designated and defined by units and sub -units, to -wit: East Side of Avenue A from its intersection with the South Property Line of 45th Street to its intersection with the South Property Line of 60th Street, known and designated as Sub -Unit Number 1 of Unit Number 2192. West Side of Avenue A from its intersection with the South Property Line of 45th.,, Street to its intersection with the South Property Line of the alley Nolkh of 51st,• Street (Note - Lot A Lyndale Acres Addition is not included and no assessment is to be levied against said Lot A), known and designated as Sub -Unit Number 2 of Unit Number 2192. THAT the cost of making such improvements be partly paid for by the City of Lubbock and partly by the property abutting upon the highways and alleys or portions thereof which are hereby ordered to be improved, and the owners of such property as a personal liability, after, public hearing all in accordance with and as required by Article 1105b, of the Revised Civil Statutes of Texas amended by Chapter 281 Acts of the 52nd Legislature and amendments thereto. ,^ THAT the City Secretary be and is hereby authorized and directed to prepare a certified copy of this resolution and to record or cause same to be recorded in the Deed Records of Lubbock County, Texas. WEST SIDE OF AVENUE A FROM ITS INTERSECTION WITH THE SOUTH PROPERTY LINE OF 45TH STREET TO ITS INTERSECTION WITH,THE SOUTH PROPERTY LINE OF THE ALLEY NORTH OF 51ST r STREET (NOTE -LOT A LYNDALE ACRES,ADDITION IS NOT INCLUDED AND NO ASSESSMENT IS TO BE LEVIED AGAINST SAID LOT A), KNOWN AND DESIGNATED AS SUB -UNIT NUMBER 2 OF UNIT NUMBER 2192„ { I, Lavenia Lowe, City Secretary -Treasurer, City of Lubbock, Texas hereby certify that the above and foregoing is a true and correct copy of A RESOLUTION Passed by the City Council October 24, 1968 and of record in Minute Book 27, Page 392 THIS 30th DAY OF October , 19 68 c L11e� tC Laven a Lowe, City S retary-Treasurer City of Lubbock, Texas THE STATE OF TEXAS PAVING RELEASE COUNTY OF LUBBOCK WHEREAS, heretofore on Oct. 24, 1968 , the City of Lubbock passed a Resolution dated Oct. 24, 1968 , such instrument being recorded in Volume 491 , Page 367 of the Deed of Trust Records of Lubbock County, Texas, such Resolution containing a notice of improvements and also in such Resolution there was included an Order for Improve- ments for Paving Unit No. 2192-1&2 on Avenue A , from the South Property Line of 45th Street to the South Property Line of 60th Street (East Side) and from the South Property Line of t Street to the South Property Line of the alley N. of 51st Street, Lubbock County, Texas; and, West Side WHEREAS, under Paving Unit No. 2192-1 and 2192-2 as described above, such improvements have created no lien or liens against the abutting property in Paving Unit No. 2192-1 , and 2192-2" by reason of the fact that such paving improvements have not been made and there is no immediate plan of making street improvements upon the streets described in Unit2192-1&2 , and it is expendient to remove the cloud and apparent lien placed upon the title of property abutting the street as aforementioned; NOW THEREFORE, KNOW ALL MEN BY THESE PRESENTS: THAT the CITY OF LUBBOCK, acting by and through its officers heretofore duly authorized by Resolution of the City Commission dated July 10, 1958, and appearing in the minutes of the City Commission at Volume 17, Page 259, inconsiderationof the premises, the CITY OF LUBBOCK does hereby and by these presents, RELEASE, RELINQUISH and FOREVER QUIT CLAIM to the owner or owners of property affected by the Order for Street Improvements herein above mentioned, their heirs, administrators, executors and assigns, all right, title anc:interest it may have in and to all those lots, tracts or parcels of land abutting property lying and being situated in the City of Lubbock, Lubbock County, Texas, and being further described hereinabove. This release affects only the property herein above described and in no way affects any property or liens not specifically described herein, and all liens and apparent liens against property owners not otherwise released are hereby expressly retained.
