WHEREAS, the City Council has and hereby further determines that a public
necessity exists to reconstruct the existing strip paving on Kenosha Avenue from the
alley north of 1 Oih Street to 11 oth Street, said public necessity is to provide for improved
drainage of storm water in order to reduce risks of flooding the properties abutting said
portion of Kenosha A venue, and the City Engineer has provided for the preparation of the
plans and specifications for such improvements; and
WHEREAS, the owners of properties abutting said portion of Kenosha A venue
have requested that full width paving (36 feet in width with curb and gutter) be
constructed instead of strip paving; and
WHEREAS, the owners of these properties have indicated they will pay the
additional costs associated with the full width paving; and
WHEREAS, the City shall contract with a competent contractor for the above
street improvements, and said improvements will be constructed in accordance with the
above-mentioned plans and specifications under the supervision of the City Engineer, and
the said City desire that the Owners contribute towards such full width paving; and
WHEREAS, the contract cost of the paving improvements shall be determined by
compliance with the competitive bidding process and the City's share in connection
therewith would not exceed the cost to reconstruct the strip paving, leaving the property
owners share in the amount of the additional costs necessary to pave the street full width
with curb and gutter; NOW THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
Section 1. THAT, the City Engineer approved plans and specifications for
paving on the street herein described, and that such plans and specifications meet the
usual requirements for paving on streets within the corporate limits of the city of
Lubbock; said street being as follows, to-wit:
Kenosha A venue from the alley north of 107th Street to 11 oth Street
The City Engineer is authorized to prepare bid documents to construct said full
width paving of Kenosha Avenue, with an alternate bid to reconstruct only the strip
paving improvements.
The City Engineer is further authorized and directed to duly inspect said paving
construction on said street and to require strict compliance with the approved plans and
specifications, and upon completion of said paving, and upon final approval by the City
Engineer and acceptance of such improvements by the City Council, the City Engineer is
authorized to pay the Contractor in full and final payment of the cost of the above-
mentioned improvements.
Section 2. This authority is conditioned that the Owners of abutting property
will deposit with the City their complete portion of the cost to pave the full width paving
improvements prior to award of the bid to the successful contractor.
Section 3. In the event that the said funds are not received by the City from
the abutting property owners, the City shall construct the said improvements to strip
paving standards in conformance with the alternate bid for such strip paving
improvements.
