RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. That the City of Lubbock herein accepts the provisions of Minute Order
No. 107161 passed May 29, 1997, by the Texas Transportation Commission, which Order is
attached to this Resolution and incorporated herein as part of this Resolution.
SECTION 2. That the City of Lubbock concurs with the designation in Minute Order
No. 107161 of 82nd Street from Farm to Market Road 1739 (Slide Road) westward to U.S.
62/82 (a distance of approximately four miles) as State Highway Spur 313 on the State Highway
System.
SECTION 3. That the City of Lubbock concurs with the provisions of said Minute Order
for the widening of 82nd Street (Spur 313) from Frankford Avenue to U.S. 62/82 (a distance of
approximately 3 miles). The existing two-lane facility will be widened to a six -lane facility.

WHEREAS, in LUBBOCK COUNTY, on 82ND STREET, from Frankford Avenue to
U.S. Highway 62/82, a distance of approximately 3 miles, a project to widen the existing two-lane
facility to a six -lane facility is currently being proposed; and
WHEREAS, pursuant to the Texas Transportation Code, Sections 201.103 and 221.001,
the executive director has recommended that STATE HIGHWAY SPUR 313 be designated; and
WHEREAS, it is necessary for the convenience of the traveling public to designate 82nd
Street from Farm to Market Road 1730 (Slide Road) westward to U.S. Highway 62/82 as
STATE HIGHWAY SPUR 313 on the State Highway System in order to provide a route linking
two highways on the State Highway System; and
WHEREAS, the 82nd Street project is necessary due to the area's continuous development
and a population increase in the local school district; and
WHEREAS, the continued growth has made a significant impact on the average daily
traffic, including the local school bus traffic; and
WHEREAS, traffic models indicate that traffic will continue to increase along the 82nd
Street route, causing conditions to wo sen; and
WHEREAS, the project sere as a vital link for connecting the cities of Lubbock and
Wolfforth; and
WHEREAS, this action is consistent with the 1997-2001 Strategic Plan strategy to plan,
design, and manage highway projects and to provide for routine maintenance and operation of the
State Highway System;
NOW, THEREFORE, IT IS RDERED that the executive director is hereby authorized to
tender the following proposal to the C ty of Lubbock (the city) and Lubbock County (the county):
Provided the city and the county will:
1. Provide 100 percent of the cost of right of way, clear of obstructions, inchxUng
easements and any right of way required for environmental mitigation, with
acquisition procedures in accordance with the policies of the department and with
applicable Federal an
State laws governing policies for acquiring real property.
2. Provide 100 percent othe cost of eligible utdity adjusunents as may be required
in accordance with thepolicies of the Texas Department of Transportation
(the deparanetu).
3. Provide funds not to a reed $994,098 for construction costs.
4. Assume routine maintenance of the facility upon completion of construction-

The department will:
Provide for construction costs, currently estimated at $5.1 million to be funded in
Priority 1, Category 12, Strategic Priority Program of the 1997 Unified
Transportation Program.
IT IS FURTHER ORDERED that 82nd Street be designated on the State Highway System
as rSTATE HIGHWAY SPUR 313, from Farm to Market Road 1730 (Slide Road) westward to
U.S. Highway 62/82, a distance of approximately 4 miles; however, any existing county road or
city street within the above -referenced limits will not be designated or incorporated therein prior to
the award of the construction contract by the department; and
IT IS FURTHER ORDERED that upon acceptance of this Order by the city and the
county, the executive director is hereby authorized to proceed in the most feasible and economical
manner with project development to include the widening of 82nd Street from Frankford Avenue to
U.S. Highway 62/82 at an estimated construction cost of $5.1 million to be funded in Priority 1,
Category 12, Strategic Priority Program of the 1997 Unified Transportation Program.
IT IS UNDERSTOOD that the city and the county will continue to provide maintenance for
all county roads and city streets within the above -referenced limits until construction by the
department begins.
IT IS FURTHER UNDERSTOOD that the city and/or the county will assume maintenance
of the facility upon completion of construction.
This Order shall become operative upon acceptance by the city and the county, and if not
accepted within 90 days of the date hereof, the action concLbwd is this order shall not be
implemented.
