RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed to
execute for and on behalf of the City of Lubbock an Interlocal Agreement between the City of
Lubbock and the County of Lubbock to provide services to blade Municipal Drive from Guava to
the east city limits. Said Interlocal Agreement is attached hereto and incorporated in this
Resolution as if fully set forth herein and shall be included in the minutes of the Council.
Passed by the City Council this 26th day of June 1997.

STATE OF TEXAS
COUNTY OF LUBBOCK
§ INTERLOCAL AGREEMENT
RECITALS
Whereas a tornado struck the community of Liberty, within Lubbock County (hereinafter
County), on or about April 10, 1997, causing the scattering of debris and damage to property;
Whereas the City of Lubbock (hereinafter City), to assist the victims of the disaster and
Lubbock County, desires to allow tornado debris to be deposited in the City Landfill without
paying the customary tipping fee;
Whereas the value to Lubbock County for the City's allowing the debris to be deposited
in the City Landfill approximated SEVEN HUNDRED DOLLARS ($700.00);
Whereas neither the City nor the County declared the disaster to be an emergency, and;
Whereas both the City and the County desire to offset the City's services with in -kind
services from the County, pursuant to the authority granted and in compliance with V.T.C.A.,
Government Code §§791.001 et seq. (the Interlocal Cooperation Act) and in furtherance of the
responsibilities of said parties as provided by law, therefore the parties agree as follows:
WITNESSETH
The parties to the agreement are the City of Lubbock, Texas and Lubbock County.
ARTICLE 1. STATEMENT OF WORK
In exchange for the services rendered by the City after the Liberty tornado, the County
agrees to provide the equipment and labor to blade Municipal Drive from Guava to the east city
limits for a total of three (3) times, said services by the County the parties agree approximate the
value of SEVEN HUNDRED DOLLARS ($700.00), the sum the City would have received in
tipping fees.
ARTICLE 2. PERIOD OF PERFORMANCE
The County will perform the work specified herein within one (1) year commencing on
the date of this agreement.
ARTICLE 3. HOLD HARMLESS
Each party hereto agrees to hold the other party harmless from any claim for damages
arising out of the acts or omissions of its own agents or employees to the extent permitted by the
Constitution and laws of the State of Texas.
ARTICLE 4. AUTHORIZATION
This Agreement shall be duly authorized by the governing body of each parry as
evidenced by the signatures of each chief executive officer who has signed herein below. Each
party paying for the performance of governmental functions or services pursuant to this
agreement shall make payments therefor from current revenues available to the paying party and
be in an amount that fairly compensates the performing party for the services or functions
performed under this Agreement.
