BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK
THAT the Mayor of the City of Lubbock BE and is hereby authorized and
directed to execute for and on behalf of the City of Lubbock, a Letter of Award for liquid
chlorine for Water & Wastewater Treatment -annual pricing, by and between the City of
Lubbock and DPC Industries, Inc. of Sweetwater, Texas and related documents. Said
Letter of Award is attached hereto and incorporated in this resolution as if fully set forth
herein and shall be included in the minutes of the City Council.

Dear Mr. Gomez:
DPC INDUSTRIES, INC. has been awarded the items noted below for Underwater
Inspection & Cleaning of Potable Water Storage Facilities -Annual Pricing based on your
response to the City of Lubbock Invitation to ITB #284-02/BM.
1. A Purchase Order will be issued by the City of Lubbock and covers the category of
items shown below, and no other, during the period beginning January 23, 2003 and
ending January 22, 2004 . The City of Lubbock shall not be responsible for payment
of any invoices except those orders placed pursuant to this agreement.
2 . Category of Items:
770 TN Liquid Chlorine for Water & Wastewater Treatment@ $371.60/TN
3. DPC INDUSTRIES, INC. bid dated January 3, 2002, is incorporated into and made a
part of this agreement.
4 . Prices: As quoted.
5 . All invoices shall be directed to:

6. The City of Lubbock reserves the right to enforce the performance of this contract in
any manner prescribed by law or deemed to be in the best interest of the City of
Lubbock in the event of breach or default of this agreement. The City of Lubbock
reserves the right to terminate this agreement with a thirty (30) day written notice in
the event DPC INDUST RIES, INC. fails to perform in accordance with their proposal
dated January 3 , 2003 .

The following items take precedence over specifications for the above named Invitation to Bid (ITB).
Where any item called for in the ITB documents is supplemented here; the original requirements, not
affected by this addendum, shall remain in effect.
1. Your attention is invited to the following question and answer:
Q,UESTION: In order to offer you the most competitive price we are requesting your normal average
shipment (order quantity) of chlorine ton containers. ·
ANSWER: The City's normal order quantity of one-ton cylinders is ten to the Water Treatment
Plant, ten to the Water Reclamation Plant and nine to the Sudan Pump Station.
