Berry - 2 Tracts, Berean Baptist Add - 03_14_1968KJ:EW RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed to execute for and on behalf of the City of Lubbock a SPECIAL WARRANT DEED attached herewith which shall be spread upon the minutes of the Council and as spread upon the minutes of this Council shall constitute and be a part of this Resolution as if fully copied herein in detail. Senter, Jr ity Attorney SPECIAL WARRANTY DEED THE STATE OF TEXAS t KNOW ALL MEN BY THESE PRESENTS: COUNTY OF LUBBOCK t THAT the CITY OF LUBBOCK, a Rome Rule Municipal Corporation, for and in consideration of the sum of ONE AND NO/100 ($1.00) DOLLARS cash, and other good and valuable consideration to it in hand paid by C. M. Berry and wife, Jewel Berry, have GRANTED. SOLD and CONVEYED, and by these presents do GRANT. SELL and CONVEY unto the said Grantees, C. M. Berry and wife, Jewel Berry, all those certain lots, tracts or parcels of land located In Lubbock County, Texas, and being more particularly described as follows: TRACT I BEGINNING at the Southeast corner of Lot 2. Berean Baptist Addition to the City of Lubbock, Lubbock County, Texas; THENCE East 7. 38 feet to a point; THENCE North 16.86 feet to a point in the southeast line of said Lot 2; THENCE South 20051112" West, along the Southeast line of said Lot 2. 20.72 feet to the POINT OF BEGINNING. TRACT iI BEGINNING at a point in a Northwest line of a City of Lubbock tract of land said point being 46.04 feet South and 7.38 feet East of the Southeast corner of Lot 2, Berean Baptist Addition to the City of Lubbock, Lubbock County, Texas; THENCE South 23042157" West, along said Northwest line of said City of Lubbock tract of land, 64.48 feet to a point on the North right of way line, of 62nd Street; THENCE East 23.0 feet to a point, said point being the beginning of a curve to the lent, THENCE Northeasterly along said curve to the left, said curve having a radius of 15.0 feet and tangents of 16.0 feet, an arc distance of 28.56 feet to the end of said curve; THENCE North 71.60 feet to the POINT OF BEGINNING. TO HAVE AND TO HOLD the above described property and premises, together with all and singular the rights and appurtenances thereto in anywise belonging unto the sold Grantees, their heirs and assigns forever; and Grantor does hereby bind itself, its successors and assigns, to WARRANT and FOREVER DEFEND all and singular the said premises unto the said Grantees, their heirs and assigns, against every person whomsoever lawfully claiming or to claim the same or any part thereof, by, through or under it but not otherwise.
