WHEREAS, Article 59.06 of the Texas Code of Criminal Procedure provides for the
disposition of forfeited property seized by law enforcement officers in the performance of their
duties; and
WHEREAS, Article 59.06(d) of such Code provides that proceeds awarded to a law
enforcement agency may be spent by the agency after a detailed budget for the expenditure of the
proceeds has been submitted to the governing body of the municipality for that agency; NOW
THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK, TEXAS:
THAT the Council hereby accepts and approves the budget submitted by the Lubbock
Police Department for the expenditure of proceeds awarded to the Department in accordance
with Article 59.06 of the Texas Code of Criminal Procedure.

Subject: Forfeited Fund Budget-2004
Date: December 17, 2003
Prior to the expenditure of forfeited funds, the Texas Code of Criminal Procedure
requires a law enforcement agency to submit a budget for these funds to the governing body of
that agency.
Texas Code of Criminal Procedure article 59.06, Section d, which reads in part;
A special fund in the municipal treasury if distributed to a municipal law
enforcement agency, to be used solely for law enforcement purposes, such
as salaries and overtime pay for officers, officer training, specialized investigative
equipment and supplies, and items used by officers in direct law enforcement
duties; ... a commissioners court or governing body of a municipality may not use
the existence of an award to offset or decrease total salaries, expenses, and
allowances that the agency or the attorney receives from the commissioners
court or governing body at or after the time the proceeds are awarded ...
The budget for the funds forfeited to the Lubbock Police Department is outlined below:
Lubbock Police Department Special Investigative Fund $111,333.87
Expenses include; computer equipment, software, lab equipment, SW AT equipment, training and
travel expenses, and equipment for officers use in direct law enforcement duties.
Confidential Informant Fund
Used for the purchase of information and evidence.
Department of Treasury Asset Sharing
$63,461.39
$5,871.68
Expenses include; computer equipment, software, lab equipment, SW AT equipment, training and
travel expenses, and equipment for officers use in direct law enforcement duties.

Department of Justice Asset Sharing $74,195.95
