HomeMy WebLinkAboutResolution - 2003-R0413 - Interlocal Affiliation Agreement For Immunizations - LISD - 10_09_2003Resolution No. 2003-RO413 October 9, 2003 Item No. 24 RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock is hereby authorized and directed to execute for and on behalf of the City of Lubbock an Interlocal Affiliation Agreement for immunization health services and any associated documents by and between the City of Lubbock and Lubbock Independent School District, a copy of which Agreement is attached hereto and which shall be spread upon the minutes of this Council and as spread upon the minutes of this Council shall constitute and be a part hereof as if fully copied herein in detail. MARC MCDOUGAL, MAYOR Resolution No. 2003—R 0413 October 9, 2003 Item No. 24 INTERLOCAL AFFILIATION AGREEMENT THE STATE OF TEXAS § COUNTY OF TEXAS THIS Interlocal Affiliation agreement is made and entered into this, by and between the City of Lubbock, operating by and through it's City Health Department (hereinafter called "Department") and Lubbock Independent School District, operating as LISD Health Services (hereinafter called "LISDHS"), pursuant to Chapter 791, Government Code. WITNESSETH: WHEREAS, the Department operates medical facilities in Lubbock, Texas; and WHEREAS, LISDHS provides professional health services to LISD students; and WHEREAS, it is deemed advisable and to the best interest of the Parties to establish an affiliation agreement for the purpose of carrying out these objectives, NOW THEREFORE, for and in consideration of the foregoing and in further consideration of the mutual benefits, the parties hereto agree as follows: Term: Begin on September 1, 2003 and shall continue as long as agreed upon by the Parties to this agreement. Either party shall have right to terminate agreement upon thirty (30) days written notice to the other party. 2. Understandinw. a. The Department will: i. Provide 20 hours of immunization training for the LISDHS nurses ii. Provide all supplies needed to administer immunizations, ie: immunizations, syringes, cotton balls, alcohol preps, band aids, consent forms, and Vaccine for Children (VFC) eligibility forms iii. House all signed immunization consent and vaccine eligibility forms and enter all immunizations given into the computer system iv. Provide access for LISD nurses at the Department as part of their immunization training V. Maintain an adequate supply of vaccine for the LISD clinics f OU'6 - E-0 Lt1 vi. Inform LISD staff of any changes in the policies and protocols regarding the VFC program b. LISD will: i. Participate in 20 hours of immunization training at the Department prior to scheduling any immunization clinics ii. Maintain vaccine in coolers with frozen ice packs at all times before, during, and after an immunization clinic iii. Secure signed consent and VFC eligibility form from each parent prior to administration of vaccine iv. Assure that varicella vaccine is transported and stored in dry ice during each immunization clinic V. Report any vaccine wastage at the end of each clinic, ie: spilled, wrong temperature, etc. vi. Return all vaccine and signed consent forms to the City of Lubbock Health Department according to clinic protocol vii. Prepare an outreach sheet of all children receiving immunizations and immunization provided viii. Keep informed regarding immunization schedules and changes ix. Review emergency protocols and have access to an emergency kit during each clinic X. Follow VFC requirements/guidelines for each immunization provided xi. Provide the department with the name, title, and license number for each nurse who will be participating in the immunization administration process This Agreement may be amended in writing to include such other provisions as the parties may agree upon. 4. Venue in any action at law or equity in relation to and in connection with this Agreement shall be Lubbock County, Texas. 5. Each party shall indemnify and hold harmless the other with respect to all claims, costs, and expenses (including attorney's fees) arising from the negligence or misconduct of the indemnifying Party or its employees or agents with respect to provision of services pursuant to this Agreement, insofar as allowed by the laws and the constitution of the State of Texas. 6.
