HomeMy WebLinkAboutResolution - 111067B - Convassing And Declaring Special Election Results - 11_10_1967n1o101rs RESOLUTION AND ORDER CANVASSING RETURNS AND DECLARING RESULTS OF SPECIAL ELECTION HELD IN TAE CITY OF LUBBOCK, TEXAS, ON NOVEMBER 9, 19,67, ON THE QUESTION OF ADOPTION OF A ONE PERCENT (1%) LOCAL SALES AND USE TAX WITHIN SAID CITY THE STATE OF TEXAS [O * WdM 6 2001111iiI«04 COUNTY OF LUBBOCK ON THIS the /0I-4 day of /1�a�ctlB! , 1967, the City Council of the City of Lubbock, Texas, convened in J!oycl, 4 session, being open to the public, at the regular meeting place thereof in the City Hall, there being present and in attendance the following members: W. D. ROGERS, JR. MAYOR JANES H. GRANBERRY, D.D.S. ) JACK KASTMAN ) COUNCILMEN RAY J. DIEKEMPER, JR. ) W. E. MEDLOCK ) and W. R. BLACKWELL CITY MANAGER and (MRS.) LAVENIA LOWS CITY SECRETARY/ also being present; and with the following absent: �dLc:- , constituting a quorum; at which time the following, among other business was transacted: Councilman 25-72214A/introduced the following resolution and or ec�'r: WHEREAS, there was held in the City of Lubbock, Texas, on the 9th day of November, 1967, an election at which there were submitted to the duly qualified resident electors of said City for their action thereupon, the following propositions: "FOR" adoption of a one percent (1%) local sales and use tax within the city. "AGAINST" adoption of a one percent (1%) local sales and use tax within the city. WHEREAS, there were cast at said election & �9S , of which number there were cast: PROPOSITION "ADOPTION OF A ONE PERCENT (1%) LOCAL SALES AND USE TAX WITHIN THE CITY" "FOR" "AGAINST" 2ZZZ votes votes. MAJORITY "FOR "tWAI#� THE ADOPTION OF A ONE PERCENT (1%) LOCAL SALES AND USE TAX WITHIN THE CITY" votes, as shown in the official election returns heretofore lawfully submitted to the City Council of the City of Lubbock, Texas, and filed with the City Secretary of said City of Lubbock; and, WHEREAS, only duly qualified resident electors of said City voted at said election, and said election was called and held in strict conformity with the laws of the State of Texas; therefore, BE IT RESOLVED AND ORDERED BY THE CITY COUNCIL OF THE TY OF LUBBOCK, TEXAS: SECTION 1: That the election described in the preamble to this resolution and order was duly called and notice thereof given in accordance with law; that said election was held in the manner required by law; that only duly qualified resident electors of the City of Lubbock, Texas, voted at said election; that due returns of said election have been made by the proper officers; that said election resulted favorably to the proposition: FOR THE ADOPTION OF A ONE PERCENT (1%,) LOCAL SALESAND USE TAX WITHIN THE CITY: and that a majority of the qualified voters of said City of Lubbock, Texas, voting at said election, have voted in favor of approving and adopting a One Percent (1%) Local Sales and Use Tax within said City. SECTION 2: That the City Council of the City of Lubbock, exas, hereby officially and affirmatively declares that said ne Percent (1%) Local Sales and Use Tax within said City has een properly and lawfully adopted in accordance with the pro- isions of Article 1066c, Vernon's Texas Civil Statutes (Acts 967, 60th Legislature, Regular Session, Chapter 36, Page 62). SECTION 3: That the City Secretary is hereby authorized directed to transmit to the Comptroller of Public Accounts the State of Texas in Austin, Texas, by United States istered Mail, or by United States Certified Mail, a certified y of this Resolution and Order Canvassing the Returns of Special Election, under the official seal of the City of Lubbock Texas, showing the approval of said Local Sales and Use Tax by the qualified voters of said City, together with a map of said City clearly showing the boundaries thereof as of the date of said election. The resoluti n and order was read in full, and thereupon Councilm, moved that any rule pro- hibiting the pagsage of resolutions and orders on the day on which introduced, unless declared an emergency measure, be suspended for the reasons set forth and defined in the preamble thereto. The motion was seconded by Councilman �rR/� ✓l�F.e and carried by the following vote: AYES: Mayor Rogers, and Councilmen Granberry, Kastman, Diekemper and Medlock. NOES: None Councilman J! -if,4,416&zX3' then moved that the resolution and order be finally passed as an emergency measure.
