HomeMy WebLinkAboutResolution - 2835 - Lease Agreement Amendment - TPWD - Additional Acreage, LLL State Historic Site - 05_12_1988Resolution #2835 May 12, 1988 Item 20 HW:dw RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed to execute for and on behalf of the City of Lubbock a Lease Agreement Amendment between the City of Lubbock and the Texas Parks and Wildlife Department for additional acreage for the proper development and operation of the Lubbock Lake Landmark State Historic Site, attached herewith, which shall be spread upon the minutes of the Council and as spread upon the minutes of this Council shall constitute and be a part of this Resolution as if fully copied herein in detail. TRAVIS Executive Director Attached is an amendment to the lease agreement for Lubbock Lake for the residence and proposed maintenance facility site. Please have the appropriate City staff review the document and obtain the necessary signatures if the agreement meets your approval. I will then obtain signatures on this end and forward a copy to you. We will provide as much advance notice as possible prior to occupying the residence to enable your employee to make the necessary arrangements. If I can provide any additional information, please advise. Sincerely, 10/ DWIGHT I LLIFORD Head, Park Master anning Parks Division DW:smg Attachment Resolution #2835 JCR:dw LEASE AGREEMENT AMENDMENT STATE OF TEXAS § KNOW ALL MEN BY THESE PRESENTS: COUNTY OF LUBBOCK § THAT, WHEREAS, on the 30th day of December, 1966, the Texas Parks and Wildlife Department ("Department") and the City of Lubbock, a Home Rule Municipality of Lubbock County, Texas ("City"), entered into that certain Lease Agreement ("Agreement") recorded in Volume 2500, Page 140 of the Deed Records of Lubbock County, Texas, for the purpose of establishing a state historic site now named the Lubbock Lake Landmark State Historic Site ("Site"); and WHEREAS, the parties hereto have determined that additional acreage is required for the proper development and operation of the Site; NOW THEREFORE, for and'in consideration of the premises and other good and valuable consideration, the Agreement is hereby amended for all purposes by adding to the property described in Exhibit C of the Agreement that certain real property containing 1.29 acres, more or less, situated in Section 17, Block A, Lubbock County, Texas, being more particularly described by metes and bounds as follows: BEGINNING at a spike set for the Northwest corner of the herein described 1.29 acre tract from which the Northeast corner of Section 18 and the Northwest corner of Section 17, Block A, Lubbock County, Texas, bears N 15021130" W 35.53 feet; THENCE S 89010133" East along the north line of said tract 241.09 feet to a spike set for the Northeast corner of this tract; THENCE S 0049'27" West a distance of 233.28 feet to a spike set for the Southeast corner of this tract; THENCE N 89010133" West a distance of 241.09 feet to a spike set for the Southwest corner of this tract; THENCE N 0049127" East a distance of 233.28 feet to the POINT OF BEGINNING. together with existing improvements and the right of ingress and egress utilizing the existing road.
