RESOLUTION
WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality
located in Lubbock County, Texas, has determined and does hereby
determine that the public needs, safety and welfare demand and create a
public necessity for the acquisition of additional land for municipal
public uses and purposes, to -wit: for the widening of Quirt Avenue, and
this City Council of said City finds it in the public interest and for
public purposes and municipal purposes to proceed with the acquisition of
lands as needed for such purposes as aforesaid; NOW THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the fee simple title to the following described
tracts of land located in Lubbock County, Texas, be acquired for public
purposes and municipal purposes as set forth in the preamble hereof, to -
wit:
TRACT 1
DESCRIPTION of the proposed right-of-way for Quirt Avenue, out of
Section 23, Block "E", Lubbock County, Texas, and being more
particularly described as follows:
BEGINNING at a 1/2" iron rod set the Northwest and beginning corner
of this tract, whence the Southeast corner of Section 1, Block "E"
bears North 87°37'36" West, a distance of 60.00 feet and North
02'22'24" East, a distance of 2014.00 feet;
THENCE S. 87037'36" East, a distance of 20.68 feet to a 1/2" iron
rod, set for the Northeast corner of this tract;;
THENCE S. 03°51'34" West, a distance of 384.40 feet to a 1/2" iron
rod, set for the Southeast corner of this tract;
THENCE N. 87041'26" West, a distance of 10.71 feet to a 1/2" iron
rod, set for the Southwest corner of this tract;
THENCE N. 02022'24" East, a distance of 384.26 feet to the POINT OF
BEGINNING.
TRACT 2
DESCRIPTION of the proposed right-of-way for Quirt Avenue, out of
Section 23, Block "E", Lubbock County, Texas, and being more
particularly described as follows:
BEGINNING at a 40d nail, set for the Northwest and beginning corner
of this tract; whence the Northeast corner of Section 1 bears North
87041126" West, a distance of 60.00 feet and North 02*22124" East,
a distance of 2642.34 feet;
THENCE S. 87041'26" East, a distance of 4.38 feet to a 1/2" iron
rod, set for the Northeast corner of this tract;
THENCE S. 03051134" West, a distance of 28.11 feet to a 1/2" iron
rod, set for the Southeast corner of this tract;
THENCE N. 88000'39" West, a distance of 3.65 feet to a 40d nail,
set for the Southwest corner of this tract;
THENCE N. 02*22124" East, a distance of 28.12 feet to the POINT OF
BEGINNING.
SECTION 2. THAT the owners of said tracts, including Mary Louise
Breedlove Kingsbery; individually and as independent administrator of the
estate of Aulyne King Breedlove, deceased, and Bill R. Kingsbery, BE
offered through the Right -of -Way Department of the City of Lubbock the
amount of $1,843.00, which is the amount appraised as the value and total
damages for the fee simple title and acquisition of said real estate
hereinabove described, for the use and benefit of the City of Lubbock,
Texas, for the purposes herein stated, and unless accepted forthwith, the
City Attorney of said City of Lubbock is hereby authorized and instructed
to institute condemnation (eminent domain) proceedings to acquire the fee
simple title to said land as hereinabove described for public purposes
and municipal purposes.
