A, Lot� '/ ALEX "' O MAYOR RO TEMPORE ATTEST: Ka Darnell, City Secretary APPROVED AS TO CONTENT: Ed Bucy, Right -of -Way Agent APPROVED AS TO FORM: Harold Willard, Assistant City`Attorney H W: gs/ccdocs/d-JSInc.res Deccmber 11, 1996 RESOLUTION NO.5392 Item #12 January 23, 1997 THE STATE OF TEXAS COUNTY OF LUBBOCK QUITCLAIM DEED KNOW ALL MEN BY THESE PRESENTS: THAT the CITY OF LUBBOCK, a Home Rule Municipality in the County of Lubbock, State of Texas, hereinafter called "GRANTOR," for and in consideration of the sum of TEN AND NO/100 DOLLARS ($10.00) and other good and valuable consideration to GRANTOR in hand paid by JOE STETTHEEIIER, INC., dba HERITAGE HOMES, hereinafter called "GRANTEE," the receipt of which is hereby acknowledged, does hereby by these presents ABANDON, DISCLAIM, RELEASE and FOREVER QUITCLAIM unto the said GRANTEE, all of GRANTOR'S rights, title and interest in and to these certain tracts or parcels of land lying and being situated in the County of Lubbock, State of Texas, described as follows, to -wit: TRACT 1 Lot 19 and that portion of Lot 20, Block 13, Myrtle Slaton Addition Number 2, an addition to the City of Lubbock, Lubbock County, Texas, lying West of the proposed West right of way line of Indiana Avenue and further described as follows: BEGINNING at a 1/2" iron rod set at the Northwest corner of said Lot 19 for the Northwest comer of this tract; THENCE N 89°59' 10" E, along the North line of said Lots 19 and 20, a distance of 66.78 feet to a 1/2" iron rod set in said right of way line for the Northeast comer of this tract; THENCE S 0'00' 17" E, along said right of way line, a distance of 132.50 feet to a 1/2" iron rod set in the South line of said Lots 19 and 20 for the Southeast comer of this tract; THENCE S 89°59' 10" W, along said South line, a distance of 66.79 feet to a 1/2" iron rod set at the Southwest corner of said Lot 19 for the Southwest comer of this tract; THENCE N 0°00'00" E, along the West line of said Lot 19, a distance of 132.50 feet to the PLACE OF BEGINNING. TRACT 2 The East 68 feet of Lot 15 and that portion of Lot 16, Block 16, Myrtle Slaton Addition Number 3, an addition to the City of Lubbock, Lubbock County, Texas, lying West of the proposed West right of way line of Indiana Avenue and further described as follows: BEGINNING at a 1/2" iron rod set at the Northwest corner of said East 68 feet for the Northwest corner of this tract; THENCE N 89°59'10" E, along the North line of said Lots 15 and 16, a distance of 89.86 feet to a cross on concrete set in said right of way line for the Northeast corner of this tract; THENCE S 0°00'17" E, along said right of way line, a distance of 130.00 feet to a cross on concrete set in the South line of said Lots 15 and 16 for the Southeast corner of this tract; THENCE S 89°59'10" W, along said South line, a distance of 89.87 feet to a 1/2" iron rod set at the Southwest corner of said East 68 feet for the Southwest corner of this tract; THENCE N 0°00'00" E, along the West line of said East 68 feet, a distance of 130.00 feet to the PLACE OF BEGINNING. TO HAVE AND TO HOLD the same premises together with all and singular the rights, privileges and appurtenances thereto in any manner belonging unto the said GRANTEE, its successors and assigns forever, so that neither the GRANTOR, its successors or assigns, nor any persons claiming under GRANTOR shall at any time hereafter have, claim or demand any right to the title to the aforesaid premises or appurtenances or any part thereof.
