RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor Pro Tempore of the City of Lubbock BE and is hereby authorized and
directed to execute for and on behalf of the City of Lubbock a Permit for Western Geophysical
Company to conduct a geophysical survey upon lands owned or leased by the City of Lubbock,
which permit is attached hereto and shall be spread upon the minutes of the Council and as spread
upon the minutes of this Council shall constitute and be a part of this Resolution as if fully copied
herein in detail.

GEOPHYSICAL PERMIT
Western Geophysical hereby requests permission to conduct a geophysical survey on the following
described lands, owned or leased by you for _ Exploration for Oil and/or Gas
Description -The Northeast one quarter (NE/4 of Section 43) and the North Eighty_Acres of the
Northwest one quarter /80 of NW/4) of Section 44, Block A. RE & W.T.Ry.Co. Survey,
Lubbock County, Texas
Damages will be paid in the amount of $1,000.00 per mile of vibrator lines only plus any.
damage done to growing crops. Damages will be paid after all survey lines have been laid but
prior to the actual seismic survey. Approximate Vibe Miles: 1/2 to 1 1/2 miles
Western Geophysical operations will be conducted in accordance with good standard practices and in a
prudent and careful manner, and we agree to hold you free and harmless from any and all claims for
damages that may result from Western Geophysical activity on your lands.
If for any reason, Western Geophysical is unable to complete operations on the above described lands,
this permit and all terms thereof shall become null and void, save and except Western Geophysical will
at all times continue to hold the City of Lubbock free and harmless from any and all claims for damages
that may result or have resulted from the company's activities on City property. This permit may be
cancelled by the City of Lubbock at any time, with or without cause, and neither the City nor its officers
and employees shall be liable to Western Geophysical or any nonparty to this Permit for any damages
incurred as a result of cancellation. This permit shall expire six (6) months after City Council approval -
Western Geophysical would appreciate your signing this permit letter, indicating your permission for
Western Geophysical to enter upon your lands for such purposes, and returning the top copy in the
enclosed envelope.

these lands.
