BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock BE and is hereby authorized and
directed to execute for and on behalf of the City of Lubbock an Agreement
for twelve month extension of Transportation Management Contract to be
entered into by and between said City and McDonald Transit Associates,
Inc., containing certain modifications of the original contract between the
parties dated September 8, 1983, attached herewith, which shall be spread
upon the minutes of the Council and as spread upon the minutes of this
Council shall constitute and be a part of this Resolution as if fully
copied herein in detail.

TRANSPORTATION MANAGEMENT CONTRACT
THE STATE OF TEXAS § §
KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF LUBBOCK § §
THIS CONTRACT AND AGREEMENT, made and entered into on this,
the _ 14thday of May , A.D., 1987, by and between the
City of Lubbock, a Home Rule Municipal Corporation of the State
of Texas, hereinafter called "City", and McDonald Transit
Associates, Inc., a Texas Corporation, hereinafter called "McDT".
W I T N E S S E T H:
WHEREAS, the City and McDT entered into a contract and
agreement on the 8th day of September, 1983, for the provision of
transportation management and advisory services, and
WHEREAS, the initial term of that agreement was from the
first day of October, 1983 through the last day of September,
1986, and
WHEREAS, the agreement provides ". . . and thereafter shall
be automatically renewed for successive periods of twelve (12)
months unless at least 60 days prior to the end of any twelve-
month effective period either party shall serve written notice
upon the other that it desires cancellation, revision, or
modification of any provision or provisions of this agreement."
and
WHEREAS, the agreement was so renewed, and the current
renewal period ends on the last day of September, 1987, and
WHEREAS, the parties desire to continue the contract and
agreement for an additional twelve-month period with certain
mutually agreed modifications,
NOW THEREFORE, the parties hereto do covenant and agree as follows:
I.
That this agreement shall serve as the written notice
required in Section II of the original agreement of September 8,
1983.
II.
That the term of the current agreement shall be extended
for twelve months, beginning on the first day of October, 1987,
and ending on the last day of September, 1988.
That the compensation during this twelve-month extension
shall be the sum of SIX THOUSAND FIVE HUNDRED THIRTY dollars
($6,530.00) per month.
IV.
The parties further agree that "other expenses of the
operation of the bus transportation system", mentioned in Section
XI as being reimbursable by the City, shall.include any legal
fees directly related to the operation of the transportation
system concerning labor or employment matters.
V.
All other provisions of the agreement between the parties of
September 8, 1983, shall remain in effect during the term of this
twelve-month renewal.
IN WITNESS WHEREOF, the parties hereto have executed this
contract and agreement on the 14th day of May
A.D., 1987 as of the date and year aforesaid.
