RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock BE and is hereby authorized
and directed to execute for and on behalf of the City of Lubbock a
contract between South Plains Association of Governments and the City of
Lubbock, Grant No. SF 87 A01-0858, attached herewith, which shall be
spread upon the minutes of the Council and as spread upon the minutes of
this Council shall constitute and be a part of this Resolution as if
fully copied herein in detail

AGREEMENT BETWEEN SOUTH PLAINS ASSOCIATION OF GOVERNMENTS
AND THE CITY OF LUBBOCK

i
1. This agreement is'made and entered into by and between South Plains Association
of Governments, acting as GRANTEE AGENCY, and the City of Lubbock, acting as
SERVICE PROVIDER, in aid of Criminal Justice Division grant number
titled: Regional Crime Prevention Program/4, attached hereto as Exhibit A.
2. South Plains Association of Governments, as the GRANTEE AGENCY, shall be re-
sponsible for the administration of the regional crime prevention program and
the coordination of crime prevention programs. The City of Lubbock, as the
SERVICE PROVIDER, shall act as the sponsoring agency, providing 25% of a
Lubbock Crime Prevention officer's time to present crime prevention programs
within the City of Lubbock during regular duty hours, and vehicles and video
equipment to be used by the officers in presenting crime prevention programs
in the 15 county SPAG region.
3. The GRANTEE AGENCY is.responsible for closely monitoring the SERVICE PROVIDER
and the excerise of reasonable care to enforce all terms and conditions of the
grant.
4. Requirements of the Uniform Grant and Contract Management Standards (UGMS) pro-
mulgated pursuant Texas Civil Statutes to Article 4413 (32G) are adopted by re-
ference as part of this contract, including the contract provision as in
Attachment 0, item 14, of the above standards. The GRANTEE AGENCY shall keep
all project records. Records shall be preserved for three (3) years for in-
spection by CJD, or any state or federal agency authorized to inspect the same.
5. The SERVICE PROVIDER shall furnish the services, facilities, equipment, material,
etc., as cited in item 2 above.
6. Payment for the above shall be made as follows:
A. The GRANTEE AGENCY shall reimburse the SERVICE PROVIDER for vehicle usage
by police officers for crime prevention activities allowable under the grant
on a quarterly basis at 22Q per mile.
B. Police Officers or other police department personnel, providing off duty crime
prevention programs in the region shall be independent contractors.
C. The City of Lubbock shall be reimbursed for a portion of a Lubbock Police De-
partment Crime Prevention officer's salary and fringe benefits not to exceed
$9,765 for the grant year. Payment shall be made quarterly.
7. Billing for the above shall be provided the same as would be provided to
institutional purchasers in the absence of a grant and shall consist of a
brief statement of the service or other item provided and the basis for the
billing rate.
8. In the event of a default of the SERVICE PROVIDER, the GRANTEE AGENCY may cancel
or suspend the contract and the SERVICE PROVIDER Shall be entitled to recover for
all services provided or materials delivered prior to the cancellation date (or
unused materials may be returned) or shall repay any funds advanced for services
not yet rendered.
9. All licenses, legal certifications, or inspections required for the services,
facilities, equipment, or materials, and all applicable state and federal laws
and local ordinances shall be complied with by the SERVICE PROVIDER. Failure
to comply with this requirement shall be treated as a default.
10. This contract shall become effective October 1, 1987, and automatically terminate
on the grant expiration date or any extension thereof granted by CJD. All services
billed hereunder must be rendered within the grant period.

(A) Officer Salary - SPAG will continue to contract individually with trained officers
to present programs in the region. Officers will be paid the base rate of $11.69
per hour for off duty time with no fringe benefit. It is anticipated, based upon
previous years, that the officers will work 423 hours and be paid a total of $4,945.
SPAG will contract with the cities of Lubbock and Plainview to pay a portion of the
Crime Prevention officers regular duty salary and fringe to provide crime prevention.

I. Objectives and Need for this Assistance.
Crime statistics continue to indicate that Lubbock has a high crime rate, in
fact one of the highest in the state. Lubbock is the hub of the South Plains
region and the fourteen counties surrounding the hub are affected by Lubbock's
high crime rate. Crime prevention and citizen involvement are the best ways
to decrease that rate. The objective of this program is to educate the general
public to be aware of their surroundings, to secure their homes, and to be ob-
servant for neighbors; all of which lead to a decrease in criminal activity.
II. Results and Benefits Expected.
Through an organized crime prevention program covering every county and city
on the South Plains, it is expected that the crime rate will ultimately be reduced.
The Regional Crime Prevention Program will continue to present crime prevention
training and public education programs at schools, civic clubs, banks, and
businesses, as well as offer security checks for homes and businesses. The
requests for these programs have increased with each grant year.
III. Approach
a. SPAG will continue to contract with the trained crime prevention officers of
the City of Lubbock Police Department to provide programs in the region on
off duty time. In addition SPAG will contract with the City of Lubbock and
Plainview to secure a portion of their full time Prevention officers regular
time to provide for full, regional coverage of crime prevention services. In
doing so, the Lubbock and Plainview Crime Prevention grants will be com-
bined with the SPAG Regional Crime Prevention Program to provide a
consolidated program.
These officers have established contacts throughout the region and will con-
tinue current activities. The crime prevention officer who works on his off -
duty time will continue to contact civic groups, businesses, schools to sche-
dule and offer programs. The City of Lubbock officer will continue crime
prevention programs and services in high crime sections of the City of
Lubbock. The City of Plainview officer will continue his scheduled television
and radio spots, home and business checks, and presentations. Both officers
will be available to do programs outside Lubbock and Plainview as needed.

ASSURANCES
The Applicant hereby assures and certifies that he will comply with the regulations, policies, guidelines and re—
quirements, including OMB Circular: No. A-95, A-102 and No .q-87 , as they relate to the application, accept—
aoce and use of Federal funds for this federally —assisted project. Also the Applicant assures and certifies to
the grant that:
1. It possesses legal authority to apply for the grant; that a
resolution, motion or similar action has been duly
adopted or passed as an official act of the applicant's
governing body, authorizing the filing of the application,
including all understandings and assurances contained
therein, and directing and authorizing the person identi•
fied as the official representative of the applicant to act
in connection with the application and to provide such
additional information as may be required.
2. It will comply with Title VI of the Civil Rights Act of
1964 (P.L. W352) and in accordance with Title VI of
that Act, no person in the United States shall, on the
ground of race, color, or national origin, be excluded
from participation in, be denied the benefits of, or be
otherwise subjected to discrimination under any pro-
gram or activity for which the applicant receives Federal
financial assistance and will immediately take any mea-
sures necessary to effectuarte this agreement
3. It will comply with Title VI of the Civil Rights Act of
1964 (42 USC 2000d) prohibiting employment discrimi-
nation where (1) the primary purposes of a grant is to
provide employment or (2) discriminatory employment
practices will result in unequal treatment of persons who
we or should be benefiting from the grant -aided activity.
4. It will comply with requirements of the provisions
of the Uniform Relocation Assistance and Real Property
Acquisitions Act of 1970 (P.L. 91-646) which provides
for fair and equitable treatment of persons displaced as a
result of Federal and federally assisted programs.
5. It will comply with the provisions of the Hatch Act
which limit the political activity of employees.
6. It will comply with the minimum wage and maximum
hours provisions of the Federal Fair Labor Standards
Act, as they apply to hospital and educational Institu-
tion employees of State and local governments.
7. It will establish safeguards to prohibit employees from
using their positions for a'purpose that is or gives the
appearance of being motivated.by adesire for private
gain for themselves or others, particulltrly those with
whom they have family, business, or other ties.
8. It will give the sponsoring agency or the Comptroller
General through any authorized representative the
access to and the right to examine all records, books,
papers, or documents related to the grant.
9. It will comply with all requirements imposed by the
Federal sponsoring agency concerning special
requirements of law, program requirements, and other
administrative requirements.
10.It will i re that the facilities under its ownership, lease or
supervision which shall be utilized in the accomplishment of the
project are not listed on the Environmental Protection Agency's
(EPA) list of violating Facilities and that it will notify the
Federal grantor agency of the receipt of any communication from
the Director of the EPA Office of Federal Activities indicating
that A facility to be used in the project is under consideration
for listing by the EPA.
ll.It will comply with the flood insurance purchase requirements of
Section 102(a) of the Flood Disaster Protection Act of 1973, Public
Law 93--234, 87 Stat. 975, approved December 31, 1976. Section
102(a) requires, on and after March 2, 1975, the purchase of flood
insurance in communities where such insurance is available as a
condition for the receipt of any Federal finazicial assistance for
construction or acquisition purposes for use in any area that has
been identified by the Secretary of the Department of Housing and
Urban Development as an area having special flood hazards.

The phrase "Federal financial assistance" includes any form
of loan, grant, guaranty, insurance payment, rebate, subsidy,
disaster assistance loan or grant, or any other form of
direct or indirect Federal assistance.
12. It will assist the Federal grantor agency in its compliance
with Section 106 of the National Historic Preservation Act
of 1966 as amended (16 U.S.C. 470), Executive Order 11593,
and the Archeological and Historic Preservation Act of
1966 (16 U.S.C. 469a-1 et seq.) by (a) consulting with the
State Historic Preservation Officer on the conduct of
investigations, as necessary, to identify properties listed
in or eligible'for inclusion in the National Register of
Historic Places that are subject to adverse effects(see 36 CFR
Part 800.8) by the activity, and notifying the Federal
grantor agency of the existence of any such properties, and
by (b) complying with all requirements established by the
Federal grantor agency to avoid or mitigate adverse effects
upon such properties.
13. It will comply with the Uniform Grant and Contract Management Standards
(UGCMS) developed under the directive of the Uniform Grant and Contract
Management Act of 1981, Texas Civil Statutes, Article 4413(32g).

A RESOLUTION
WHEREAS, the Criminal Justice Division of the Governor's Office has
emphasized programs which enhance citizen involvement in crime preven-
tion efforts, and;
WHEREAS, the Criminal Justice Division of the Governor's Office may
provide funds for the establishment and administration of regional
crime prevention units to work cooperatively with regional entities;
NOW, THEREFORE, BE IT RESOLVED:
1. That the administrative staff of the South Plains Association
of Governments prepare and transmit to the Criminal Justice
Division of the Governor's Office an application for $23,596.
2. That the Executive Director of SPAG be authorized to execute
documents so administratively required by the Criminial Justice
application process.
