RESOLUTION'
WHEREAS, the City of Lubbock has heretofore made substantial
purchases of chlor-alkali products for use by the City Water Department,
and
WHEREAS, several manufacturers of chlor-alkali products have
been charged with violation of the antitrust laws of the United States, and
WHEREAS, it has been determined by the City Council to be in the
best interest of the City of Lubbock to attempt to recover damages for
any possible antitrust law violations, NOW THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. That James W. Wilson of the law firm of McGinnis,
Lochridge, Kilgore, Hunter & Wilson, of Austin, Texas, be retained as
special counsel for the City of Lubbock, Texas, to prosecute a treble dam-
age action under the antitrust laws of the United States based on the City's
purchases of chlor-alkali products (chlorine, caustic soda and soda ash),
under the terms and conditions set forth in Mr. Wilson's letter of Septem-
ber 29, 1967, to the City Attorney, and that the said James W. Wilson be
authorized to institute such legal proceedings and take such other action
on behalf of the City of Lubbock in connection with such litigation as he may
deem appropriate.
SECTION 2. That the Mayor of the City of Lubbock be and is here-
by authorized and directed to accept and confirm for and on behalf of the
City of Lubbock the terms and conditions of retaining Mr. James W. Wilsot
as special counsel in such litigation as set forth in his letter of September
29, 1967 to the City Attorney of Lubbock.
