HomeMy WebLinkAboutResolution - 032367A - Paving Release - High Plains Pavers, Inc. - Units A-391-28 & A-391-29 - 03_23_1967IITGB:EW RESOLUTION WHEREAS, heretofore the City of Lubbock passed Ordinance No. 5184, suc) Ordinance being.recorded in Volume 1117, Page 629 of the Deed Records of Lubboc County,!, Texas, and such Ordinance assessed a lien upon property abutting certain alleys described therein; and, WHEREAS, some of the subunits as listed in such Ordinance were not con- structed and su6h improvements have created no liens against the property assesse by reason of the fact that such paving improvements have not been made and there i no immediate plan of making alley improvements upon such subunits; and, WHEREAS, it is expedient to remove the cloud and apparent lien placed upoi the title of the property abutting the alleys to be improved which were included in the subunits hereinafter listed; NOW THEREFORE; BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the Mayor of the City of Lubbock is hereby authorized and dirocted to execute a joint paving release with High Plains Pavers, Inc. of the following subunits at the location specified as set out in Ordinance No. 5184, which subunits being released are described as follows; UnitA7391-28 The East-West alley between 58th Street and 59th Street and from the West Property Line of Avenue P to 135. 00 feet West of the West Property Line of Avenue P Unit A-391-29 The Fast -West alley between 59th Street and 60th Street and from the West Property Line of Avenue P to 130. 00 feet West of the West Property Line of Avenue P SECTION 2. THAT the City Secretary of the City of Lubbock is authorized and directed to attest the Release for the City of Lubbock. SECTION 3. THAT such release shall affect only property abutting on alleys included in the subunits above mentioned as embodied in Ordinance No. 518, of the' City of Lubbock and such release shall release only the property specifically described therein. ROGE R' 11AyOR r �lL�� Leivenia Lowe, C461ty Secretary -Treasurer APPROVED: THE STATE OF TEXAS I PAVING RELEASE COUNTY OF LUBBOCK X WHEREAS, heretofore, on February 9, 1967. the City of Lubbock passed Ordinance No. 5184, such instrument being recorded in Volume1117, Page 622 of the Deed Records of Lubbock County, Texas, such Ordinance containing a notice of improvements and apportionment of costs of such improvements, by assessing a lien upon the property abutting hereon, and in such Ordinance there was included paving assessments for certain hereinafter described Paving Sub -Units or Leave - outs; and, WHEREAS, under such Paving Sub -Units or Leave -outs, such improvements have created no lien or liens against the property assessed pursuant to said Paving Sub -Units or Leave -outs, by reason of the fact that such paving improvements have not been made and there is no immediate plan of making alley improvements upon --- the alleys under said Paving Sub -Units or Leave -outs, and it is expedient to remove the cloud and apparent lien plat ed upon the title of property abutting the alleys as aforementioned: NOW THEREFORE: KNOW ALL MEN BY THESE PRESENTS: THAT the City of Lubbock and High Plains Pavers, tar,,, acting by and through their officers heretofore duly authorized in consideration of the premises, do hereby and by these presents, RELEASE, RELINQUISH and FOREVER QUIT- CLAIM to the owner or owners of property affected by the paving assessment liens hereinabove mentioned, their heirs, administrators, executors and assigns, all right, title and interest the City of Lubbock and High Plains Pavers, Inc. may have in and to all these lots, tracts or parcels of land being situated in the City of Lubbock, Lubbock County, Texas, and being further described as follows, to -wit: Unit A-891-28 The East-West alley between 68th Street and 59th Street and from the West Property Line of Avenue P to 185. 00 feet West of the West Property Line of Avenue P Unit A-891-29 The East-West alley between 69th Street and 60th Street and from the West Property Line of Avenue P to 190.00 feet West of the West Property Line of Avenue P This Release affects only the property hereinabove described and in no way affects any property or liens not specifically described herein, and all liens and apparent liens against property owners not otherwise released are hereby expressly retained.
