HomeMy WebLinkAboutResolution - 2355 - Minute Order - TDHPT - US 62_82 Project - 06_26_1986Resolution #2355 June 26, 1986 Agenda Item #28 JWF:js RESOLUTION WHEREAS, the City Council of the City of Lubbock is in receipt of a copy of Minute Order No. 84439 of the State Department of Highways and Public Transportation of the State of Texas (herein called "State"), passed May 28, 1986, related to a request by the City of Lubbock (herein called "City"), for U. S. Highway 62/82 to be upgraded to a freeway from Loop 289 Southwest of Lubbock to Interstate Highway 27 a distance of 6.8 miles; and WHEREAS, such request of the City was granted to the extent that the State designated U. S. Highway 62/82 a controlled access facility from Loop 289 to Avenue Q in said Minute Order No. 84439 in accordance with the terms and conditions thereof and acceptance of said Minute Order No. 84439 by the City; and WHEREAS, the City Council of the City of Lubbock finds that it is to the public interest and public safety of the citizens of the City of Lubbock to accept such Minute Order to the end that the traffic dispersal system of the City of Lubbock and the State will be mutually beneficial to the general welfare of the City and State; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT a copy of said Minute Order No. 84439 is hereby annexed hereto and made a part of this Resolution. SECTION 2. THAT the proposal of said Minute Order tendered to the City by the Engineer -Director for the State as evidenced by said Minute Order is hereby accepted by passage of this Resolution by the governing body of the City. SECTION 3. THAT it is understood by the City that the costs, parti- cularly with respect to acquisition of right-of-way and relocation of utilities, shall be shared by the State and the City with the State to pay ninety percent (90%) of the costs and the City pay ten percent (10%) of the costs as and when such funds are lawfully appropriated and/or lawfully are made available by the State and the City to fund the freeway project. S. HIGHWAY 62/82, from Loop 289 southwest of Lubbock to Interstate Highway 2 a distance -of -approximately 6.8 miles, the City of Lubbock has -requested that this section be upgraded to a freeway; and WHEREAS, the State Department of Highways and Public Transportation wishes to assist with this request; and WHEREAS, the City of Lubbock will have certain responsibilities; NOW, THEREFORE, the Engineer -Director is directed to tender the following proposal to the City of Lubbock: Provided the City will: 1. Secure necessary right of way free of obstructions and, provide for the adjustment of utilities as necessary, according to policies of the State Department of Highways and Public Transportation with acquisition proce- dures to be in accordance with applicable federal and State laws governing the acquisition policies for acquiring real property. 2. Provide for the construction of continuous curb and gutter where none now exist, storm sewers, etc., all as may be necessary for a complete project with the exception of pavement and its support, in accordance with Department policies. inrm Jz08 Re.. Assume responsibility for the construction of driveways and sidewalks where none now exist should they be deemed necessary now or in the future and agree to make such installations in accordance with governing policies and regulations of the the Department. 4. Maintain that portion of the work which is its responsibility in accordance with present maintenance agreements, and agree to regulate traffic and pre- vent encroachment on the right of way, all in accordance with governing policies and regulations of the Department. The State Department of Highways and Public Transportation will: 1. Proceed with project development through determination of right of way requirements. 2. Designate U. S. Highway 62/82 a CONTROLLED ACCESS FACILITY from Loop 289 to Avenue Q for development, maintenance and operation in accordance with the provisions of H.B. 179, 55th Legislature, and the Engineer -Director is directed to be governed accordingly in location, design, -acquisition of right of way, construction, operation and maintenance of future improvements. It is understood that construction funding for right of way acquisition and construc- tion has not been authorized, however upon completion of determination of right of way requirements, this matter should be returned to the Commission for consideration of funding authorization for right of way acquisition and construction. This Order shall become operative upon acceptance by the City of Lubbock and if not accepted within 90 days of the`°date hereof, the action herein contained shall be automatically cancelled.
