RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock be and is hereby authorized
and directed to execute for and on behalf of the City of Lubbock a Gas Pipe
Line Easement to Pioneer Natural Gas Company attached herewith which
shall be spread upon the Minutes of the Council and as spread upon the Min-
utes of tlris Council shall constitute and be a part of this Resolution as if
fully copied herein in detail.
Passed by the City Counc4 this loth day of November 1966.

COUNTY OF LUBBOCK KNOW ALL MEN BY THESE PRESENTS:

THAT the City of Lubbock, a Home Rule Municipal Corporation, of
Lubbock County, Texas, acting herein by and through its officer heretofore
duly authorized, for and in consideration of the sum of ONE AND N0/100
($1.00) DOLLAR cash in hand paid by the Pioneer Natural Gas Company,
a Texas Corporation, of Lubbock County, Texas, receipt of which is hereby
acknowledged and confessed, has Granted, Bargained, Sold and Conveyed,
and by these presents does Grant, Bargain, Sell and Convey unto the said
Pioneer Natural Gas Company an easement in, along, upon, under, through
and across that certain tract of land located and situated in Lubbock County,
Texas, more particularly described as follows:
BEGINNING at the point of intersection of the Northeast right
of way line of 29th Drive with the Northwest line of the Atcheson,
Topeka and Santa Fe Railway Company right of way, said point
being 1126.29 feet North 53 degrees 54' East of a point in the
West line of Section 17, Block B, Lubbock County, Texas, said
point in the West line of said section being 431 feet North O degrees
Olt 25" West of the Southwest corner of said Section 17, Block B;
THENCE North 36 degrees 06t West, along the Northeast right of
way line of said 29th Drive, a distance of 7.5 feet to the beginning
point of this description;
THENCE North 53 degrees 541 East, parallel to and 7.5 feet
Northwest of the Northwest line of said railroad right of way, a
distance of 175 feet to a point;
THENCE South 36 degrees 061 East a distance of 7.5 feet to the
end of this description.
for the purpose of ;constructing, operating and maintaining or removing
a 20 inch H.I,P. steel natural gas pipe line; provided, however, that the
Grantee herein shall place and construct said line within and along the
easement herein granted in an approved manner and hereby agrees and
obligates itself to compact the backfill in such manner so as to prevent
settlement and to otherwise keep and maintain such pipe line with as little
damage to the premises as may be practicable considering the nature of
the construction and use to which said premises are to be put and further
granting the Pioneer Natural Gas Company the right to enter upon said
described land for the purpose of maintaining or repairing or removing said
natural gas pipe line at any time and season and providing further that
Grantee herein shall repair or pay for any damage occasioned by any
necessary maintenance or repair or removal work. In the event this
natural gas pipe line interferes with the Grantorts use of the above des-
cribed tract of land, the Grantee shall make the necessary adjustments in
the said pipe line at its own expense. The acceptance by Grantee of delivery
of this conveyance and the exercise of the rights and uses permitted herein
shall constitute an acceptance of the obligations imposed upon Grantee.
TO HAVE AND TO HOLD all and singular the premises aforesaid
unto the said Pioneer Natural Gas Company, its successors signs.
