JOINT RESOLUTION

( WHEREAS, the City Council of the City of Lubbock and the Commissioners
Court of the County of Lubbock have entered into contract for the City to provide
library services to the-County; and,
WHEREAS, such contract provides for the County.to pay to the City such
sum as may be agreed upon by the City and County; and,
WHEREAS, the City and County have agreed that the merged library syste
will require a budget of $210,000.00 during its first year; NOW THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK AND
THE COMMISSIONER'S COURT OF LUBBOCK COUNTY ACTING JOINTLY
SECTION 1. THAT the City and County of Lubbock hereby agree on a
budget for the "Lubbock City-County Libraries" for the year 1966-67 (October 1,
1966, through September 30, 1967) in an amount of $210,000.00.
SECTION 2. THAT the County of Lubbock shall pay to the City of Lubbock
40% of the $210,000.00.in return for the City assuming the functions of a public
free library.
SECTION 3. THAT this resolution is,passed pursuant to a contract
signed the loth day of November, 1966, by the City and County,

LIBRARY CONTRACT
This agreement entered into this loth day of November, 1966, by
and between Lubbock County (herein called County) and the City of Lubbock
(herein called City).
WITNESSETH:
WHEREAS, the City and County have expressed the desire to enter
into a contract to provide a single library system to provide enhanced services
to both the City and the County, and
WHEREAS, the City has and maintains an extensive established free
library which is capable of being expanded to serve the City and County toget-
her, NOW THEREFORE:
In consideration of the mutual covenants hereinafter set forth, City
and County agree:
I.
The City shall provide library service as, and shall assume the
functions of a county free library within Lubbock County including incorporated
cities and towns therein.
II.
The librarian of the City shall hold or secure a county librarian's
certificate from the State Board of Library Examiners.
III.
County shall pay annually into the City such sum as may be agreed upon
to be paid out of the county library fund. Such sum and percentage participation
of each party shall be agreed upon by formal resolution of the parties hereto on
or before the 15th day of August of each year hereafter. It is agreed that 507o
of the sum to be paid by the County will be paid on or before February 15th of
each year and the remaining 50%to be paid on or before July 15th of such year.

As part of the consideration for the services to be rendered by the
City of Lubbock hereunder, all books and other library equipment, including
all equipment presently used in the County library system, now owned by the
County, save and except, the law library and its fixtures, shall become the
property of and vest in the City on the effective date of the merger. An
inventory of such property and an estimated current value thereof shall be
prepared by the County and accepted by the City.
V.
Personnel now employed by the County in its library system will be
offered employment in the merged library system at wages not less than those
paid by the County. If such employees accept employment with the City, they
shall be subject to all personnel policies of the City, including the position
classification and compensation plans, except however, the compulsory re-
tirement age which is declared to be inapplicable to such employees until
September 30, 1968.
VI.
City except as otherwise provided herein shall have sole control, admin-
istration, and direction over the merged library system which shall continue as
a department of the City, and over the system Is employees. The annual budget
as well as matters of policy, shall, however, be subject to approval by majority
vote of the governing bodies of both the City and County. Monthly operational
and fiscal reports will be submitted to the County Auditor by the Director of the
merged system. "Policy" as that term is used herein is hereby defined to be
those matters which require approval and action by the City Council.

All citizens of Lubbock County shall have equal privileges with
respect to library services of the merged system.
VIII.
Subject to the terms of Paragraph VI City reserves the right to
contract to provide library services to other governmental subdivisions
and entities formed providing library services.
IX.
A joint library advisory board of five city appointees and four county
appointees shall be created by joint resolution of the City and County prior
to effective date of the merger.
X.
The merged system shall be known as "Lubbock City-County Libraries".
XI.
The effective date of the merger of the library systems shall be
January 1, 1967.
XII.
This contract shall continue in full force and effect until such time as
the parties heretol�may mutually agree by written resolution to terminate it,
provided, however, City or County may terminate this contract by giving six
months written notice of intention to do so to the other party.
IN WITNESS HEREOF, City and County have respectively caused this
agreement to be duly executed as of the loth day of November, 1966.
