THAT the Mayor of the City of Lubbock is hereby authorized and directed to execute a Partial Release of certain abutting properties from any lien or cloud of title which could have been created by the filing of Resolution 2132 of the City of Lubbock in the Deed of Trust Records of Lubbock County, Texas by reason of the fact that such abutting property will not be assessed for street improvements on North quaker Avenue because such abutting property lies adjacent to state highway right-of-way or paving improvements would not enhance the value of the abutting property to the extent of the estimated cost of such paving improvements. SECTION 2. THAT a copy of said Release is annexed hereto. Passed by the City Council this 9th day of January , 1986. Resolution #2212 V5L r16 1.22 169® PARTIAL RELEASE C`^v!'DE0 / u�THE STATE OF TEXAS § R'_ COUNTY OF LUBBOCK § WHEREAS, Resolution No. 2132 of the City of Lubbock ordered proposed street improvements on North Quaker Avenue from Clovis Road to Loop 289, which Resolution was passed on September 12, 1985 and was recorded in Volume 954, Pages 625-627 (inclusive) of the Deed of Trust Records of Lubbock County, Texas; and WHEREAS, the City of Lubbock does not desire to assess a portion of the abutting property lying parallel to such improve- ments by reason of the fact that such abutting property lies adjacent to state highway right-of-way or paving improvements would not enhance the value of the abutting property to the extent of the estimated cost of such paving improvements; and WHEREAS, the City of Lubbock now desires to release such portions of abutting property from any lien or cloud of title which may or could have been created by the filing of record of said Resolution No. 2132 in the Deed of Trust Records of Lubbock County, Texas, as aforesaid; NOW THEREFORE: KNOW ALL MEN BY THESE PRESENTS: THAT for and in consideration of the premises as set forth in the preamble hereof, the City of Lubbock hereby releases the following described abutting properties from any lien or cloud of title which may or could have been created by the passage and recordation of said Resolution No. 2132 in Volume 954, Pages 625-627 (inclusive) of the Deed of Trust Records of Lubbock County, Texas, by reason of the fact that such abutting property lies adjacent to State Highway right of way or paving improvements would not enhance the value of the abutting property to the extent of the estimated cost of such improvements, as set forth below, to -wit: (1) NO ASSESSMENT - PROPERTY ABUTTING STATE HIGHWAY RIGHT-OF-WAY. A. South 84.40 feet of Lot 275 and Lots 274, 277 and 346, DePauw McLarty Addition to the City of Lubbock, Lubbock County, Texas. B. Tract "A", Charter Hospital Addition to the City of Lubbock, Lubbock County, Texas. C. Property described by metes and bounds as follows: BEGINNING at a point which bears South 00°06'52" East a distance of 3701.80 feet and East a dis-tance of 65.00 feet from the Northwest corner of Section 18, Block A, Lubbock County, Texas, said point being in the East ROW line of North Quaker Avenue; THENCE East a distance of 170.00 feet to a point; THENCE South 09°33106" West a distance of 378.76 feet to a point; THENCE West a distance of 172.80 feet to a point, said point being in the East ROW line of North Quaker Avenue; THENCE North 19°33'27" East a distance of 5.25 ,feet to a point, said point being in the East ROW line of North Quaker Avenue; VOLME314 Pk f226 THENCE Northeasterly along the East ROW line of North Quaker Avenue around a curve to the left, said curve having a radius of 1095.00 feet, a central angle of 19040'09", tangent lengths of 189.82 feet and a chord distance of 374.06 feet to the POINT OF BEGINNING. Property described by metes and bounds as follows: BEGINNING at a point which bears South 00'06'52" East a distance of 4075.50 feet from the Northwest corner of Section 18, Block A, Lubbock County, Texas, said point being in the East ROW line of North Quaker Avenue; THENCE East a distance of 150.00 feet to a point; THENCE South 00'06152" East a distance of 146.67 feet to a point; THENCE West a distance of 150.00 feet to a point in the East ROW line of North Quaker Avenue; THENCE North 00'06'52" West along the East ROW line of North Quaker Avenue a distance of 146.67 feet to the POINT OF BEGINNING. E. Property described by metes and bounds as follows: BEGINNING at a point which bears South 00006'52" East a distance of 4222.17 feet from the Northeast corner of Section 5, Block J-S, Lubbock County, Texas, said point being in the East ROW line of North Quaker Avenue and being the Northeast corner of the following described tract: That portion of the East 1154.46 feet of the South 1067.50 feet of the Southeast quarter of Section 5, Block J-S, lying East of the East ROW line of North Quaker Avenue. (2) NO ASSESSMENTS - PAVING IMPROVEMENTS WOULD NOT ENHANCE A.
