BY— an_ ,/,_ T Title Commune wb evelopment Administrator Resolution #2195 DEMOLITION CONTRACT THE STATE OF TEXAS KNOW ALL MEN BY THESE PRESENTS: COUNTY OF LUBBOCK THAT first party, City of Lubbock, desiring the demolition of the premises located at 1.) 1302 4th Street, Lubbock, Texas; and 2). on the rear of 1302 East 4th Street, Lubbock, Texas, and more particularly described as 1). the South 122.0 feet of Lot 14, Block 8, William Tubbs Addition to the City of Lubbock, Lubbock County, Texas; and 2). Lots 1, 2, 3 and 4 in Block 8, William Tubbs Addition to the City of Lubbock, Lubbock County, Texas, according to the Map or Plat thereof filed for record in the Office of the County Clerk of Lubbock County, Texas, less right-of-way as set out in Volume 1294, page 777 of the Deed Records of Lubbock County, Texas; and Tot 13 in Block 8, William Tubbs Addition to the City of Lubbock, Lubbock County, Texas, according to the Map or Plat thereof filed for record in the Office of the County Clerk of Lubbock County, Texas, and Tot 14 in Block 8, William Tubbs Addition to the City of Lubbock, Lubbock County, Texas, according to the Map or Plat thereof filed for record in the Office of the County Clerk of Lubbock County, Texas; less the South 122 feet of lot 14, Block 8, William Tubbs Addition, and second party, Trevino Paving , a bonded demolition con- tractor, do hereby agree that second party will in exchange for the consideration expressed herein perform the following acts: 1) demolition of all structures located on the above described premises and removal of said structures, their components, materials and residue, 2) removal of all weeds, non -cultivated vegetation and all trash, garbage and similar waste material, 3) filling of all manmade excavations with approved fill matter and 4) levelling of the lot to proper drainage grade. It is understood that the provisions of this contract will be performed and completed within 30 days of this date. It is further understood that the work by second party will be done in a good and workmanlike manner. This shall be con- strued to include, but not be limited to, the following covenants: A) protection shall be provided to pedestrians in sidewalk areas during the demolition as required by Chapter 44, of the Building Code of Lubbock, B) all utilities shall be properly disconnected, including electricity, water, gas and sewer, C) proper and adequate safeguards shall be provided to protect the general public, employees of second party, and adjoining property: second party specifically agrees to hold first party harmless for any injuries to . persons or property, occasioned during the performance of this contract which are attributable to negligence of first party of arise from a failure to honor this covenant and, D) all trash and rubbish are to be removed from the adjacent, alleyway and disposed of pursuant to City Ordinance requirements pertaining to trash removal. The sole consideration for the above covenants and agreements shall be the right of second party to all salvageable material removed from the lot, plus ninptpon ( 19,720.OQ DOLLARS. Second thny acknowl- edges and confesses the sufficiency of suc consideration. It is expressly understood that second party is to acquire no interest whatsoever in the realty itself. During the performance of this contract, the contractor agrees as follows: 1) The Contractor shall not discriminate against any employee or applicant for employment because of race, color, religion, sex, or national origin. The Contractor shall take affirmative action to ensure that applicants for employment are employed, and that employees are treated during employment without regard to their race, color, religion, sex, or national origin. Such action shall include, but not be limited to, the following: employment upgrading, demotion, or transfer; recruitment to recruitment advertising; layoff or termination; rates of pay or other forms of compensation; and selecting for training, including apprenticeship. 2) The Contractor shall post in conspicuous places, available to employees and applicants for employment, notices to be provided by Contracting Officer setting forth the provisions of this nondiscrimination clause. The Contractor shall state that all qualified applicants will receive consideration of employment without regard to race, color, religion, sex, or national origin. .3) Contractors shall incorporate foregoing requirements in all subcontracts.
