HomeMy WebLinkAboutResolution - 2180 - Agreement - TDHPT - Traffic Signals, 4 Location I27 & US84 - 10_24_1985Resolution #2180 October 24, 1985 Agenda Item #30 JWF:rm RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed to execute for and on behalf of the City of Lubbock an agreement to be entered into by and between said City and the Texas State Department of Highways and Public Transportation concerning installation of traffic signals at four locations on the Frontage Roads of the IH-27 route through Lubbock attached herewith which shall be spread upon the minutes of the Council and as spread upon the minutes of this Council shall constitute and be a part of this Resolution as if fully copied herein in detail. Enclosed for review and execution by the City of Lubbock are five (5) copies of an agreement, as well as a City Secretary's Certification, in connection with the proposed installation of traffic signals at four locations on the Frontage Roads of the IH-27 route through Lubbock. These locations are described specifically in the Exhibits attached to the agreement. If these documents are found to be acceptable after your review, please secure the signatures required for their execution by the City. City S retary of the City f Lubbock , Texas j s s Resolution #2180 STA►E OF TEXAS 4 COUNTY OF TRAVIS This AGREEMENT, dated this 24th day of October , 1985 , by and between the State of Texas, hereinafter called the "State," Party of the First Part; and the City of Lubbock, Lubbock County, Texas, acting by and through its duly authorized officers under an Ordinance/Resolution, passed the 24th day of October , 19 85 , herinafter called the "City," Party of the Second Part, is made to become effective when fully exe- cuted by both parties. W I T N E S S E T H WHEREAS, the City has authorized the installation of highway traffic signal(s) by Ordinance/Resolution, passed on the 24th day of October 19 85 , at the locations shown on EXHIBIT 1, attached hereto and made a part hereof; A G R E E M E N T NOW, THEREFORE, in consideration of the premises and of the mutual covenants and agreements of the parties hereto to be by them respectively kept and performed, as hereinafter set forth, it is agreed as follows: 1. The State will furnish the necessary funds for the actual construction, prepare plans and specifications, install said highway traf- fic signals, and supervise construction. . 2. The City hereby consents to the construction of the highway traffic signals shown on EXHIBIT 1 by the approval of the location and manner of construction as shown on the plans and described in the specifications. 3. The City will operate and maintain the highway traffic signals at City's expense upon completion of the installations by the State. 4. The City will pay all power costs for operating the signals. AGREEMENT (TRAFFIC SIGNAL - TYPE E-1A) 1-3 11-84 7 S ` 5. The City will obtain written approval of the State Department of Highways and Public Transportation before making any changes it the design of operation and timing of the signals or before removing any part of the installations. 6. The City will return any and all parts of said highway traffic signal installations to the State should they be removed by the City for any reason other than for installation on a State or Federal numbered highway route at a location approved by the State. 7. The City will be responsible for the police enforcement required for securing obedience to the highway traffic signals. 8. In the event the signals installed in accordance with this Agreement become unnecessary or are removed for any reason, this Agreement shall terminate. 9. To the extent permitted by law, the City shall indemnify and save harmless the State, its agents or employees, from all suits, actions or claims and from all liability and damages for any and all injuries or damages sustained by any person or property in consequence of any neglect in the per- formance, or failure of performance of the City, its agents and employees under this Agreement. 10. The State will not incur any financial obligation to the City as a result of this Agreement.
