HomeMy WebLinkAboutResolution - 092266G - Denial For Surrounding Communites To Enter Into Extraterritorial Jurisdiction - 09_22_1966 I � ' LGAS•kks RESOLUTION WHEREAS, the City of Lubbock falls within. the provisions of Section 3.A. tfi) of Article 970a, Vernon's Annotated Texas Statutes, which grants to cities of 100, 000 or more inhabitants, an extraterritorial jurisdiction consisting of all the contiguous unincorporated area, not a part of any other city, within five (5) miles of the corporate limits of such cities; and, WHEREAS, Section 8A of Article 970a states that no city may be incorpor- ated within the area of the extraterritorial jurisdiction of any city withbut the written consent of the governing body of such city; and, WHEREAS, a request for such consent has been made to initiate incorpor- ation. proceedings for a portion of what is known as the "Carlyle Community", such portion to be known as "Westshire Village"; and, WHEREAS, a study has been made to determine the needs of the citizens both within the City of Lubbock and those in its extraterritorial jurisdiction, in- cluding the "Carlyle Community"; NOW THEREFORE,' IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK SECTION 1. THAT the incorporation of a small part of a community is not in the public interest of the citizens of the City of Lubbock or those within its extraterritorial jurisdiction. SECTION 2.' THAT the request for permission to initiate proceedings to incorporate "Westshire Village", a small part of the "Carlyle Community" shout be, and the same is hereby DENIED.
