HomeMy WebLinkAboutResolution - 4279 - Agreement - SPFA - Local Matching Funds, Broadway Streetscape Project - 10_14_1993Resolution No. 4279 October 14, 1993 Item #32 RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed to execute for and on behalf of the City of Lubbock a Landscaping Agreement by and between the City of Lubbock and the Panhandle -South Plains Fair Association for the beautification of the southern boundary of the fair- grounds along East Broadway between Avenue A and the present entrance to Mackenzie Park, attached herewith, which shall be spread upon the minutes of the Council and as spread upon the minutes of this Council shall constitute and be a part of this Resolution as if fully copied herein in detail. JohfisbliV, City Secretary APPROVED AS TO CONTENT: Dgm rtram, Assistant City Manager/ yelopment Services APPROVED AS TO FORM: ljorfaia ti. vanaiver, first AssIs City Attorney DGV:js/LA-PSPF.RES Di-Agenda/September 16, 1993 Resolution No. 4279 October 14, 1993 Item #32 THE STATE OF TEXAS § LANDSCAPING AGREEMENT COUNTY OF LUBBOCK § WHEREAS, the Panhandle -South Plains Fair Association, hereinafter called "Fair," desires to beautify the southern boundary of the fairgrounds along East Broadway between Avenue A and the present entrance to Mackenzie Park; and WHEREAS, the City of Lubbock, hereinafter called "City," desires to assist the Fair with the beautification through it's Broadway Streetscape project; and WHEREAS, the City has the opportunity to nominate the Broadway Streetscape as a project for the Statewide Transporta- tion Enhancement Program provided for by the Intermodal Transportation Efficiency Act (ISTEA); and WHEREAS, acceptance of the project by the Texas Department of Transportation will greatly enhance the quality and magni- tude of the Broadway Streetscape project; and WHEREAS, the selection of the project by the Texas Department of Transportation requires a local match of 20 per- cent to be submitted by a local government; and WHEREAS, the City has available $622,000 for local match and the Fair has set aside $50,000 for its beautification pro- ject, which funds of the Fair will be made available to the City for a part of the local match according to the following terms and conditions. WITNESSETH: 1) Upon selection of the Broadway Streetscape project by the Texas Transportation Commission, the Fair hereby agrees to make available to the City for use as local match funds the amount of $50,000.00. 2) The City hereby agrees that the Fair shall have the opportunity to review the final plans submitted to the Texas Department of Transportation prior to submission and the City hereby agrees that the value of the improvements to be included on City right-of-way along East Broadway adjacent to the fair- grounds, as shown on Exhibit A attached hereto, shall in no event be less than the dollar amount committed to the City for local match by the Fair.
