WHEREAS,heretofore the City of Lubbock passed Ordinance No. 4657
such Ordinance being recorded in Volume 1034, Page 347 of the Deed Records
of Lubbock County, Texas, and such Ordinance assessed a lien upon property
abutting certain streets described therein; and,
WHEREAS, some of the subunits as listed in such Ordinance were not
constructed and such improvements have created no liens against the property
assessed by reason of the fact that such paving improvements have not been
made and there is no immediate plan of making street improvements upon such
subunits; and,
WHEREAS, it is expedient to remove the cloud and apparent lien placed
upon the title of the property abutting the streets to be improved which were
included in the subunit hereinafter listed; NOW THEREFORE;
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the Mayor of the City of Lubbock is hereby authorized
and directed to execute a joint release with Kerr Construction Company of the
following subunit at the location specified as set out in Ordinance No. 4657,
which subunit being released is described as follows:
Unit 2139-1 West 1/2 of Quirt Avenue from 15.00 feet North of the
North property line of East Dartmouth Street (East Leg)
to 16.00 feet North of the North property line of Auburn
Street.
Part of
Unit 2139-2 Quirt Avenue from 15.00 feet North of the North Property
Line of East Dartmouth (East Leg) to 188.18 feet North
of the North Property Line bf East Erskine Street
(East Leg). The below described lots and tracts only
to be released.
Tract B, Mackenzie Manor Addition
Beginning at a point 60.00 feet South of the Southeast
corner of Tract B, Mackenzie Manor Addition to the
City of Lubbock, Lubbock County, Texas;
Thence South 1040.07 feet;
Thence West 100.00 feet;
Thence North 1040.07 feet;
Thence East 100.00 feet to the point of beginning.
Part of
Unit 2139«3 Quirt Avenue from the North R.O.W. line of the Santa
�., Fe R.R. to 890.00 feet South of the South Property Line
of East Itasca Street (West Leg).

The below described lots and tracts only to be released.
_ The East 415.60 feet of Lot 7 and all of
Lots 1, 8, 9 and 10, Block 1, Meadowbrook
Acres Addition.
Beginning at a point 20.00 feet North of Tract B.
Mackenzie Manor Addition to the City of Lubbock,
Lubbock County, Texas;
Thence North 1014.00 feet;
Thence West 100.00 feet;
Thence South 1014.00 feet;
Thence East 100.00 feet to the point of beginning.
SECTION 2. THAT the City Secretary of the City of Lubbock is
authorized and directed to attest the Release for the City of Lubbock.
SECTION 3. THAT such release shall affect only property abutting on
streets included in the subunits above mentioned as embodied in Ordinance
No, 4657 of the City of Lubbock and such release shall release only the
property specifically described therein.

PAVING RELEASE
COUNTY OF LUBBOCK �
WHEREAS. heretofore, on April 18, IP65, the City of Lubbock passed
Ordinance No. 4657, ouch instrument being recorded in Volume 1084, Page
947 of the Deed Records of Lubbock County, Texas, such Ordinance con-
taining a notice of improvements and apportionment of costs of such improve-
ments, by assessing a lien upon the property abutting thereon. and in such
Ordinance there was included paving assessments for certain hereinafter
described Paving Sub-Units or Leave-outs, and,
WHEREAS, under such Paving Sub-units or Leave-outs, such improve-
ments have created no lien or liens against the property assessed pursuant
to said Paving Sub-untts or leave-outs, by reavon of the fact that such
paving improvements have not been made and there is no immediate plan
of making street improvements upon the streets under said Paving Sub-units
or Leave-outs, and it is expedient to remove the cloud and apparent lien
placed upon the title of property abutting the street as aforementioned:
NOW THEREFORE:
KNOW ALL NTEN BY THESE PRESENTS: THAT the City,of Lubbock
and the Kerr Construction Company, acting b., and through their officers
heretofore duly authorized in consideration of the premises, do hereby
and by these presents RELEASE, RELINCUISH and FOREVER s UITCLAITA
to the owner or oviners of property affected by the paving asaessment liens
hereinabbve mentioned, their hetre, administrators, executors and assigns,
all right, title and interest the City of Lubbock and the I:err Construction
Company may have in and to all this lot, tract or parcel of land and being
situated in the City of Lubbock, Lubbock County, Texas, and being further
described 60 follows, to-wit:
Unit 218c)'-1 west 1/2 of Quirt Avenue from 15.00 feet North of
the North property line of East Dartmouth Street
(East Leg) to 16.00 feet North of the North property
line of Auburn Street.
Part of
Unit 2189-2 Quirt Avenue from 15.00 feet North of the North
Property Line of East Dartmouth (East Leg)to
188.18 feet North of the North Property Line W
East Erskine Street (East Leg). The below
described lots and tracts only to be released.
Tract E, Mackenzie :&nor Addition
Beginning at a point 60.00 feet South of the
