HomeMy WebLinkAboutResolution - 111165M - Creation Of Community Action Board In Lubbock County - 11_11_1965 GAS:bw fi—/ This Resolution was rescinded by a - 4 Resolution passed by the City Council= r" ,J November 23 1965. \� JOINT RESOLUTION WHEREAS, the Congress of the United States of America has enacted Public Law 88-452, and otherwise known as the "Economic Opportunity Act of 1964!'; afiO, WHEREAS, the best interests of the City and County of Lubbock will be served by taking advantage of Federal Assistance in the program of combating poverty, as provided for in Public Law 88-452; and, WHEREAS, numerous programs of action are available under the juris- diction of various units of government and voluntary social agencies; and, WHEREAS, there is a need for co-ordinating the work of such agencies, reviewing the problem areas not covered by adequate programs and suggesting direction of such programs; and, WHEREAS, no agency exists to co-ordinate the work both of voluntary private agencies and governmental agencies; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK AND THE COMMISSIONERS= COURT OF LUBBOCK COUNTY, TEXAS: SECTION 1. THAT a Community Action Board in Lubbock County be and is hereby created as follows: (a) Members shall be appointed and composed as follows: One City of Lubbock Councilman or his alternate, as selected by the City Council of the City of Lubbock. One Lubbock County Commissioner or his alternate, as selected by the Commissionerst Court of Lubbock County. One member of the School Board, as selected by the School Board of the Lubbock Independent School District. One member of the Community Planning Council, as selected by the Community Planning Council. One member of the United Fund Board, as selected by the United Fund Board. One member of the Ministerial Alliance of Lubbock, as chosen by the Ministerial Alliance. Four citizens living outside the City Limits of Lubbock, appointed by the Lubbock County Commissionerst Court. Five citizens living inside the City Limits of Lubbock, appointed by the City Council of the City of Lubbock. f Three persons representing census tracts 8, 11 and 12, recommended by the Community Planning Council and appointed jointly by the Lubbock City Council and the Lubbock County Commissionerst Court. Three persons appointed jointly by the Lubbock City Council and the Lubbock County Commissionerst Court. (b) Each member shall serve for a term of three (3) years and until his successor is duly appointed and qualified, except that in the -case of those first appointed the terms shall be determined by lot so that the term of one-third (1/3) of the members shall expire on January 31, 1967, the ter of one-third (1/3) of the members shall expire on January 31, 1968, and the term of one-third (113) of the members shall expire on January 31, 1969. The replacements of the representative and appointees of the Lubbock City Council whose terms are about to expire shall be selected annually at the first meeting of the Lubbock City Council of each year hereafter. The replacements of the representative and appointees of the Lubbock County Commissionerst Court whose terms are about to expire shall be selected annually at the first meeting of the Lubbock County Commissionerst Court of each year hereafter. Members , selected jointly may be selected at a joint meeting of the Lubbock City Council and the Lubbock County Commissionerst Court or by any other method agreed to by both bodies. The names of members selected by bodies other than the Lubbock County Commissionerst Court or the Lubbock City Council should be submitted to the Lubbock City Council and to the Lubbock County Commissionerts Court in time to be ratified at the first annual meeting of each. (c) Each member of the Board shall be entitled to one vote. A majority of said Board shall constitute a quorum for the transaction of any business or the exercise of any power in the performance of any duty duly authorize or imposed. The Board may elect an executive committee, a Chairman, two Vice-Chairmen and a Secretary-Treasurer. (d) Any member of the Board other than the representatives of the Lubbock CityCouncil and the Lubbock County Commissionerst Court who without good cause misses or fails to attend three consecutive meetings of the Board shall be deemed to have resigned or refused his member- ship. Members other than the representatives of the City Council or the Commissionerst Court may be removed by either the Lubbock City Coun- cil or the Lubbock County Commissionerst Court. The selection of each member by a body other than the Lubb ck City Council or the Lubbock County Commissionerst Court must be�ratified by the Lubbock City Coun- cil and the Lubbock County Commissionerst Court before his member- ship is effective. Members who resign, refuse membership or are re- moved shall be replaced by one appointed in the same manner as the re- placed member, except that ratification may take place at any time. SECTION 2. The Board is hereby authorized to incorporate as a non- profit corporation under the laws of the State of Texas. Provided, however, that the bylaws of said Corporation shall not become effective until ratification in .writing by the City Council of the City of Lubbock and the Lubbock County Commis sioners: Court and no change in the bylaws shall be made without the same written ratification,and a provision to this effect shall appear in the by-laws. SECTION 3. The powers and duties of the Board shall be as follows (a) The Board shall contact other public agencies and the various private agencies and organizations in the City of Lubbock and Lubbock County in an effort to achieve community-wide support for any plans developed pursuant to the Economic Opportunity Act of 1964. (b) The Board shall have the power to enter into necessary contracts to secure federal financial assistance under Public Law 88-452. (c) The Board shall have the responsibility for approving or rejecting and submitting all approved requests for funds to funding sources (d) The Board shall plan, develop, and co-ordinate policies and pro- grams it determines to be needed in Lubbock County. SECTION 4, That subject to thg_foregoing, the "Community Action Board in Lubbock County" is hereby;�.u-Lzvrized to act nunt in co-operation with overnmental a subdivisions and public and private organizations in connect on with the develop- ment of a 'community action program for the purpose of mobilizing resources to combat poverty, pursuant to Public Law 88-»452. SECTION 5. That in accordance with the authority thus granted, the "Community Action Board in Lubbock County" is authorized to apply for Federal grants from the Director of the Office of Economic Opportunity for the purpose of paying all, or a part of the cost, of the Community Action Program to be developed and conducted in the Lubbock area and designed to combat poverty. SECTION 6. The following persons are hereby appointed and ratified as members of the Community Action Board in Lubbock County; 1. D. M. McElroy, Chairman 2. T. J. .Wallace, 1st Vice-Chairman 3.
