HomeMy WebLinkAboutResolution - 111165J - Joint Release - Kerr Construction Co - Hartford Ave - 11_11_1965 DS:kks_ I0 RESOLUTION WHEREAS, heretofore the City of Lubbock passed Ordinance No. 4657 such rdinance being recorded in Volume 1034, Page 347 of the Deed Records of Lubbock County, Texas, and such Ordinance assessed a lien upon property abutting certain treets described therein; and, WHEREAS, some of the subunits as listed in such Ordinance were not construc tec d such improvements have created no liens against the property assessed by reas f the fact that such paving improvements have not been made and there is no immed at lan of making street improvements upon such"subunits; and, WHEREAS, it is expedient to remove the cloud and apparent lien placed upon e title of the property abutting the streets to be improved which were included in he subunit hereinafter listed; NOW THEREFORE: E IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1, THAT the Mayor of the City of Lubbock is hereby authorized and directed to execute a joint release with Kerr Construction Company oS the following subunit at the location specified as set out in Ordinance No. 4657, which subunit being released is described as follows: Unit 2132-7 Hartford Avenue from 3t N. of the N.P,L. of Auburn Street ,(West Leg)to 121 N. of the S.P.L. of Bates Street '(West Leg). SECTION 2, THAT the City Secretary of the City of Lubbock is authorized an directed to attest the Release for the City of Lubbock. SECTION 3. THAT such release shall affect only property abutting on streets included in the subunts above-mentidned as embodied in Ordinance No. 4657 of the City of Lubbock and such release shall release only the property specifically descrit ed erein. Se nter, Jr., C' A orney THE STATE OF TEXAS � PAVING RELEASE COUNTY OF LUBBOCK WHEREAS, heretofore, on April 18. 1965, the City of Lubbock passed Ordinance No. 4667, such instrument being recorded in Volume 1034, Page 347 of the Deed Records of Lubbock County, Texas, euch Ordinance containing a notice of improvements and apportionment of costs of such improvements, by ;assessing a lien uponihe property ablating thereon, and in such Ordinance there 'was included paving assessments for certain hereinafter described Paving Sub- Units or Leave-outs; and; WHEREAS, under such Paving Sub-units or Leave-outs, such improvements have created no,lien or liens against the property assessed pursuant to said Paving Sub-units or leave-outs, by reason of the fact that such paving improvements have not been made and there is no immediate plan of making street improvements upon the streets under said Paving Sub-units or Leave-outs, and it is expedient to remove the cloud and apparent lien placed upon the title of property abuttipg the street as aforementioned: NOW THEREFORE: KNOW.ALL MEN BY THESE PRESENTS: THAT the City of Lubbock and the Kerr Construction Company, acting by and through their officers heretofore duly authorized in consideration of the premises, do hereby and by these presents, RELEASE, RELINQUISH and FOREVER QUITCLAIM to the owner or owners of property affected by the paving assessment liens.hereinabove mentioned, their heirs, administrators, executors and assigns, all right, title and interest the City of Lubbock and the Kerr Construction Company may have in and to all this lot, tract or parcel of land and being situated in the City of Lubbock, Lubbock County, Texas, and being further described as follows, to-wit: Unit 2132-7 Hardord Avenue from 8' N. of the N.P.L. of Auburn Street (West Leg) to 12' N. of the S.P.L. of Bates Street (West Leg). This Release affects only the property hereinabove described and in no way affects any property or liens not specifically described herein, and all liens and apparent liens against property owners not otherwise released are hereby expressly retained.
