RESOLUTION
WHEREAS, heretofore the City of Lubbock passed Ordinance No. 4102
such Ordinance being recorded in Volume 942, Page 191 of the Deed Records of
Lubbock County, Texas, and such Ordinance assessed a lien upon property abut-
ting certain streets described therein; and,
WHEREAS, some of,the subunits as listed in such Ordinance were not con-
structed and such improvements have created no liens against the property assesse
by reason of the fact that such paving improvements have not been made and there
is no immediateplan of making street improvements upon such subunits; and,
WHEREAS, it is expedient to remove the cloud and apparent lien placed
upon the title of the property abutting the streets to be improved which were in-
cluded in the subunit hereinafter listed; NOW THEREFORE;
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF-,LUBBOCK:
SECTION 1. THAT the Mayor of the City of Lubbock is hereby authorized
and directed to execute(a joint release with L. A. Purtell, of the following sub-
unit at the location specified as set out in Ordinance No. 4102 which subunit being
released is described as follows;
Paving Unit Location
Unit 2099-25 Cornell Street from 121 W. of the E.P,=L, of Avenue
U. to 5t W. of the W,P.L.' of Avenue T.
Part of Guava Avenue from S.P.L.' of E. 2nd Street to 3t N.
Unit 2101-2 of'he N.,P.'L. cif E. 3rd Street. The below described
tract Aly to be released:
Beginning at a point 1933.40 feet south of the
Northwest corner of the Southwest quarter of
Section 3, Block A, Lubbock County, Texas;
Thence South 50.00 feet; Thence east 209.50
feet; Thence north 50.00 feet; Thence west
209.50 feet to the point of beginning, less and
except that part indicated for streets and alleys.
Part of 17th Street from 2t W. of the W.P.L. of Avenue F
Unit 2102-1 to 272 W. of the E.P.L.I of Avenue G. The below
described assessment only to be released:
Roadbeds, ties, rails and other appurtenances
between the rails and two (2) feet either side there .
SECTION 2. THAT the City Secretary of the City of Lubbock is authorize
and directed to attest the Release for the City of Lubbock.
SECTION 3. THAT such Release shall affect only property abutting on
streets included in the subunits above-ment ioned as embodied in Ordinance No.
4102 of the City of Lubbock and such Release shall release only the property
specifically described therein.

PAVING RELEASE (JOINT)
COUNTY OF LUBBOCK i
WHEREAS, heretofore, on May 23, 1963,I the City of Lubbock passed
Ordinance No. 4102, such instrument being recorded tn Volume 942, Page 191
of the Deed Records of Lubbock County, Texas, such Ordinance containing a
notice of improvements and apportionment of costs of'i;sauch improvements, by
assessing a lien upon the property,abutting thereon' and in such Ordinance there
was included paving assessments for certain he 'or described Paving Sub-
Units or Leave-outs; and;
WHEREAS, under such Paving Sub-units or Leaveeouts, such improve-
ments have created no lien or liens against the property assessed pursuant to
said Paving Sub-units or leave-outs, by reason of the!fact that such paving im-
provements have not been made and there is no immediate plan of making street
improvements upon the streets under said]paving Sub-Units or Leave-outs, and it
is expedient to remove the cloud and apparent lien placed upon the title of pro-
perty abutting the street as aforementioned; NOW THEREFORE:

This Release affects only the property hereinabove described and in
no way affects any property or liens not specifically described herein, and all
liens and apparent liens against property owners not otherwise released are
hereby expressly retained.

Gentlemen:
I submit herewith the closing documents for 130 blocks of
street paving, known and designated as G.W.O. 10400.
Final inspection has been made of the abovementioned
improvements and said improvements have been constructed in accordance
with plans, specifications and contract documents.
I therefore recommend acceptance of the improvements.

CONTEACTOR'S AFFIDAVIT ON CLOSING JOB

COUNTY OF LUBBOCK
Before me, a Notary Public in and for Lubbock County, Texas, on this
day personally appeared L. A. Purteft , who being by me duly
sworn, upon oath says:
I, L. A. Purtell ,
do represent to the City of Lubbock and solemnly swear that I executed a contract
with the City of Lubbock, said contract being dated April 1 1963 ,
for Paring under ,
and that the work and contract has been completed according to the plans and
specifications pertaining to the project and that all labor, material, supplies
and other cost including equipment, rental and hire, and all expense items incurred
in connection with said project have been paid in full;, that all liens and rights
to fix liens against any part of said project or the moneys, bonds, or warrants
due the contractor, have been satisfied by payment to the claimant, his authorised
agent or attorney, and full release of all recorded liens or claims have been
secured by settlement and duly filed of record with the County Clerk of Lubbock
County. -
I further represent and affirm that all Federal, State and Municipal
laws were substantially complied with by me in doing and carrying out the job
and project herein referred to and that I paid applicable scale of. wages, and this
affidavit is made to secure payment from the City of Lubbock to we of the full
and final moneys due me under this contract.
