RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock BE and is hereby authorized and
directed to execute for and on behalf of the City of Lubbock an Agreement and
all related documents during the effective dates of the Agreement with the
Community Health Center of Lubbock. Said Agreement is attached hereto and in-
corporated in this Resolution as if fully set forth herein and shall be
included in the minutes of the Council.

AGREEMENT BETWEEN CITY OF LUBBOCK
AND
COMMUNITY HEALTH CENTER OF LUBBOCK, INC.
THIS AGREEMENT, entered this 22nd day of July ,
1993, by and between the CITY OF LUBBOCK (herein called "City")
and COMMUNITY HEALTH CENTER OF LIIBBOCK# INC. (herein called
"CHCL") .
WHEREAS, CHCL has received a grant from the Health and
Human Services Commission of the State of Texas for implementa-
tion and funding of the House Bill-7 Pilot Project in Lubbock
County, Texas; and
WHEREAS, CHCL is a nonprofit corporation operating within
the city of Lubbock and offering a program of services to meet
the basic needs of the residents of the city which constitutes
a valuable public service; and
WHEREAS, among the goals of the pilot program are imple-
mentation of a computer -based integrated eligibility
determination system and implementation of a coordinated infor-
mation and referral system of all available services; and
WHEREAS, City has the ability to provide technical support
for the administration of the local area network (LAN) and with
the Client Access Pilot Software (CAPS); and
WHEREAS, CHCL desires to contract with City to provide
this technical assistance;
NOW THEREFORE, it is agreed between the parties hereto
that:
I. SCOPE OF SERVICE:
A. CHCL Responsibilities:
1. CHCL agrees to pay to City from Health and Human
Services Commission grant funds TWENTY-EIGHT
THOUSAND EIGHT HUNDRED SIXTY AND NO/100 DOLLARS
($28,860.00) for LAN Administration professional
services and for software programing services.
2. CHCL agrees to reimburse City for the actual
cost of materials and supplies necessary to
maintain the LAN system upon presentation of
invoice original. Prior approval must be
obtained from CHCL for all items costing in
excess of ONE HUNDRED AND NO1 100 DOLLARS
($100.00).
City agrees to expend its best efforts to provide the
following services during the term of this Agreement:
1. City will provide technical support for the
administration of the local area network (LAN)
located at CHCL, 1318 Broadway, Lubbock, Texas
79401.
2. City's LAN administration will include the fol-
lowing:
a. LAN security
b. Backup/recovery
C. System monitoring
d. System tuning
3. City will troubleshoot technical problems for
hardware and system software associated with the
Client Access Pilot Software (CAPS) provided by
the Texas Department of Health under House Bill
7.
4. City will provide technical training on an as
needed basis through formal classes and/or
informal user sessions for the local area net-
work, hardware, system software and CAPS as
requested by CHCL.
5. City will provide user assistance via the City
of Lubbock Information Services Help Desk during
normal City business hours. An after hour tele-
phone number will be provided to CHCL for
emergencies.
6. City will provide information and referral
software development for use in conjunction with
CAPS and directly related applications. Such
software as funded under this Agreement will be
completed by December 31, 1993. Software will
be in the form of a data base comprised of
information about community services agencies
and will include the capability to collect data

and generate reports concerning referral for
services. It is understood that this Agreement
will not be the sole funding source for
information and referral software development,
and the entire software product may be developed
over the next two (2) years.
7. City, as a Subcontractor, will abide by the
applicable portions of the "Client Access Pilot
Software (CAPS) Operating Policies" established
by the Texas Health and Human Services
Commission. A copy of said policies is attached
as Exhibit A and incorporated herein by this
reference.
II. TIME OF PERFORMANCE:
The term of this Agreement shall be from March 24, 1993 to
August 31, 1993, unless continued for successive one (1)
year terms thereafter by the mutual consent of the
parties.
III. PAYMENT:
CHCL agrees to pay City TWENTY-EIGHT THOUSAND EIGHT HUN-
DRED SIXTY AND 190/100 DOLLARS ($28,860.00) for LAN
administrations professional services and for software
programing services. Payments shall be made in three (3)
installments as follows:
Upon execution of Contract $9,620.00
July 31, 1993 $9,620.00
August 31, 1993 $9,620.00
IV. NOTICES:
Communication and details concerning this Agreement shall

A. Installation
This Agreement is predicated on complete installation
of all equipment, software, communications by the
Texas Health and Human Services Commission and accep-
tance by the City of Lubbock Information Services
Department.
B. Amendments
CHCL or City may amend this Agreement at any time
provided that such amendments make specific reference
to this Agreement, and are executed in writing,
signed by a duly authorized representative of both
organizations and approved by the City Council if
required by law. Such amendments shall not invali-
date this Agreement, nor relieve or release City or
CHCL from their obligations under this Agreement.
C. Termination
Either party may terminate this Agreement at any time
by giving written notice to the other party of such
termination and specifying the effective date thereof
at least thirty (30) days before the effective date
of such termination.
VI. ADMINISTRATIVE REQUIREMENTS:
A. Records to be Maintained
City will maintain records as required by CHCL of
services provided, materials utilized, and travel
expenses, and other information pertinent to the
activities funded under this Agreement.
B. Retention
City shall retain all records pertinent to this
Agreement for a period of three (3) years after the
termination of all activities funded under this
Agreement, or after the resolution of all State audit
findings, whichever occurs later.

C. Audits and Inspections
All City records with respect to any matters covered
by this Agreement shall be made available to CHCL,
their designees or the Health & Human Services Com-
mission, at any time during normal business hours.
IN WITNESS WHEREOF, the Parties have executed this Agree-
ment as of the date first written above.
