WHEREAS„the City of Lubbock by Ordinance 14868, passed April G. 1964, filed April 17, 1964, in Vol. 985, Page 101, Deed Records, Lubbock County, Texas, assessed the following described property owned by Lubbock Commercial Buildings, Inc., and created a lien thereon for paving improve- ments to be constructed by Pioneer Pavers, Inc.: All of Late 9 and 10, Block 184, Original Town, City of Lubbock, Lubbock County, Texas; and, WHEREAS, the United States of America is acquiring title to such property by eminent domain proceedings for a public purpose to build a Post Office Building thereon; and. WHEREAS, the United States of America will not accept transfer of .Itle by judgment of the property subject to any outstanding liens; and. WHEREAS, it is contemplated the paving will not be completed till after the United States of America has acquired the property and built the Post Office Building; and, WHEREAS, the United States of America has by agreement, entered into on February 25, 1965, with the City of Lubbock assumed the obligation to pay the sum of$908.07 for each of the above described lots when the paving is completed by Pioneer Pavers, Inc.; NOW 'THEREFORE: KNOW ALL MEN BY THESE PRESENTS: THAT the City of Lubbock acting by and through its duly authorised representative for and in consideration of the foregoing premises does by these presents, release the above described property and said owner from the liens arising by virtue of said Ordinance 94868, and the original assessment in the amount of$908.07 made therein on each of said lots, but in no event shall this be construed as a cancellation of the agreement between City of Lubbock and the United States of America. dated February 25, 1965.
