RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock be and is hereby authorized and
directed to execute for and on behalf of the City of Lubbock a Quit Claim Deed
to the Lubbock Independent School District attached herewith which shall be
spread upon the minutes of the Council and as spread upon the minutes of this
Council shall constitute and be a part of this Resolution as if fully copied herein
in detail. _.._.
Passed by the City Council this 11th day of March , 1965.

KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF LUBBOCK !
THAT the City of Lubbock,, a Horne Rule Municipal Corporation of the
County of Lubbock, State of Texas, acting by and through its duly authorised
officer, for and in consideration of the sum of ONE AND NO/100 %1.00)
DOLLARS and other good and valuable consideration to it in hand paid by
LUBBOCK INDEPENDENT SCHOOL DISTRICT does hereby BARGAIN, SELL,
RELEASE, AND FOREVER QUIT CLAIM unto the said LUBBOCK INDEPENDENT
SCHOOL DISTRICT, its successors and assigns, all of the City of Lubbock's
right, title and interest to and to that certain tract or parcel of land described
as follows:
BEGINNING at the Southeast corner of Lot 24, Block 47, Overton
Addition to the City of Lubbock, Lubbock County, Texas;
THENCE West along the South line of Block 47, a distance of
600.0 feet to the Southwest corner of Lot 12, Block 47;
THENCE South a distance of 60.0 feet to the Northwest
corner of the Lubbock High School Tract;
THENCE East along the North line of said hl& school tract
a distance of 600.0 feet to the Northeast corner of said tract;
THENCE North a distance of 60.0 feet to the POINT OF
BEGINNING.
TO HAVE AND TO HOLD the said premises, together with all and
singular the rights, privileges and appurtenances thereto in any manner
belonging unto the said LUBBOCK INDEPENDENT SCHOOL DISTRICT, its
successors and assigns forever, so that neither the grantor nor its successors
or assigns, nor any person or persons claiming under the grantor shall at
any time hereafter have, claim or demand any right or title to the aforesaid
premises or appurtenances or any part thereof.

THAT the Lubbock Independent School District, acting by and through
Its heretofore duly authorized President, for and in consideration of the sum
of ONE AND N01100(al.00) DOLLARS to it in hand paid by the City of
Lubbock and other good and valuable consideration in the nstin a of the bene-
fits accruing and to accrue to the abutting property, the receipt and sufficiency
of which is hereby acknowledged, has GR ANTED, SOLD and CONVEYED, and
by these presents does GRANT, SELL and CONVEY to the City of Lubbock
for the benefit and use of the public, the City of Lubbock and all public utilities
who are franchised or may be franchised by the City of Lubbock to use the
streets and alleys of the City of Lubbock, a perpetual and permanent drainage
easement and general utility easement which includes, but is not limited to,
the right to construct, reconstruct, repair and perpetually maintain an open
drain channel, any and all types of water lines, sewer lines, gas lines, tele-
phone and telegraph lines, electric transmission limes, and any other type
of public utility equipment, whelier named herein or not, and whether now
constructed on the premises herein conveyed or to be conveyed in the future,
together with the right of ingress, egress, and regress for such purposes in,
on, under, above, through, and across all of the property described as
follows, to-wit:

Addition to the City of Lubbock, Lubbock County, Texas;

of the Lubbock High School Tract;
THENCE East along the North line of said high school tract
a distance of 600.0 feet to the Northeast corner of said tract;

BEGINNING.

easement aforesaid in anywise belonging perpetually to the City of Labbock,
its successors or assigns, and any and all public utilities who are now or
hereafter franchised by the City of Lubbock to use the City streets and alleys,
for so long as the public uses the same for the purposes herein granted.
