HomeMy WebLinkAboutResolution - 022565L - Policy For Persons In Custory Of The LPD Who Need Medical Treatment - 02_25_1965 DP:bvu ` r , d5r RESOLUTION WHEREAS, the City of Lubbock has occasion to have persons in the custody of the Lubbock Police Department who need medical attention and, WHEREAS, there is a need of clarification of the policy of the City of Lubbock regarding payment of bills which resulted from the medical treatment of persons in the custody of the Lubbock-:Police Department and, WHEREAS, the City Council of the City of Lubbock realizes that there is no legal obligation on the part of the City of Lubbock to pay medical bills of person in the custody of the Lubbock Police Department, that Police Officers are not authorized to bind the City by contract, that payment of extensive medical bills for prisoners might be an unconstitutional donation of a municipal, fund to a non- public purpose, but, that reasonable rules consistent with good human conduct and natural ethics under the circumstances dictate that prisoners should receive such immediate medical attention as good conscience would dictate under given circumstances; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:" THAT the policy of the City of Lubbock regarding medical treatment and payment of same for persons in the custody of the'Lubbock Police Department be as follows: SECTION 1. THAT the City pay for emergency (24 hour) medical care for persons who become ill or may be injured when in jail in the custody of the Lubboc Police Department, providing that the Chief of Police or his designated representa- tive authorize and approve such emergency treatment and fill otrt a City Jail. Sick and Accident Report on each person who becomes ill or injured while in the custody of the Police Department, and, SECTION 2. THAT the City pay for emergency (24hour) treatment of injuries received in the course of an arrest, and, SECTION 3. THAT the City of Lubbock will pay for room bills incurred from a "ward-type" room arrangement and not private rooms unless the nature of the injury dictates complete privacy and in the opinion of the City of Lubbock sue, privacy is necessary for the proper recovery of such person. That persons in the custody of the City of Lubbock who receive transfusions be required, if possible, to provide a blood replacement upon recovery, and, SECTION 4. THAT the City of Lubbock is not responsible for the payment of medical bills of persons who are involved in a traffic accident or a fight and are injured in such accident or fight or otherwise injured and are then taken th a hospital, by an ambulance, private vehicle, or other emergency vehicle and are later placed in the custody of the Lubbock Police Department, and, SECTION 5. THAT the City of Lubbock is not responsible for the payment 0f medical bills of persons injured in an accident or fight or otherwise ill or injure { who may be picked up by the Lubbock Police Department after such injuries and �,..., taken to a hospital by the Police Department, and, SECTION 6. THAT the City Physician be equipped to treat minor lacera- tions or illnesses in the jail on his routine rounds to the City Jail each morning, and, SECTION 7. THAT the City Manager be instructed to pay pending bills which are consistent with this policy and such bills which may arise in the future as a result of compliance with the stated 'policy.
