WHEREAS, the City Council of the City of Lubbock has heretofore determined and now finds that due to increased demands on the sanitary sewer system in the City of Lubbock, it is necessary to construct additional sanitary sewer trunk mains; and, WHEREAS, to accomplish this purpose, it is necessary to acquire, for right of way purposes, a sanitary sewer line easement through the land hereafter described; and, WHEREAS, A. E. Whitehead owns said land, and the value and total damages to ft owner for the sanitary sewer easement through said land have been appraised in the amount of $3,278.38 and the Council findssaid amount to be fair and equitable; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT a sanitary sewer line easement through the following described land situated in the City of Lubbock, Lubbock County, Texas, be acquired by the City of Lubbock for the purpose of constructing and maintaining a sanitary sewer line known and designated as Oak Avenue Lift Station Trunk Sewer Line which land is more particularly described as follows: I. Permanent easement A parcel of land out of the Northeast 1/4 of Section 3, Block 0, Lubbock County, Texas, more fully described as follows: Twenty feet in width, 10 feet either side of and parallel to the following described center line; BEGINNING at a point in the West line of Oak Avenue said point being 92.0 fee North and 50.0 feet West of the Southwest corner of Lot 11, Block 4, Rhyne Simpson Quirt Avenue Addition to the City of Lubbock, Lubbock County, Texas; THENCE West a distance of 932. 1 feet to a point, said point being 10.0 feet North of fence line; THENCE South 50 20' West a distance of 1244.3 feet to a point; THENCE South 440 27' East a distance of 165.3 feet to a point in the East lin of a tract of land conveyed to A. E. Whitehead by deed recorded in Volume 823, Page 337, Lubbock County Deed Records, said point being 32.4 feet North of th South line of the Northeast 1/4 of said Section 3, Block 0. II. Temporary working easement A strip pf land 60.0 feet wide, 30.0 feet on each side of, measured at right angles, and parallel to the above described center line. THAT the owners of said land be offered, through the Right of Way Department, the amount appraised as the value and total damages for the sanitary sewer line easement through said land for the purposes herein stated, for the use and benefit of the City of Lubbock, and unless accepted forthwith the City Attorney is hereby authorized and instructed to institute condemnation proceedings for and on behalf of the City of Lubbock to acquire the sanitary sewer line easement through said land as hereinabove described.
