RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock be and is hereby authorized and
directed to execute for and on behalf of the City of Lubbock a Release for Henry E.
Whitney„ attached herewith which shall be spread upon the minutes of the Council
'I. and as spread upon the minutes of this Council shall constitute and be a part of this
Resolution as if fully copied herein in detail.
Passed by the City Council this 5th day of November 1964.

THE STATE OF TEXAS
COUNTY OF LUBBOCK
WHEREAS, on the 14th day of November, 1969, the City of
Lubbock, by warranty deed conveyed the below described tract of land
to Henry E. Whitney, of Lubbock County, reserving a vendor's lien to
secure payment of a promissory note in the amount of ONE THOUSAND
FIVE HUNDRED AND NOf 100 ($1,500. 00) DOLLARS to be paid in three
equal annual payments with interest as more fully described hereafter;
and,
WHEREAS, on the 14th day of November, 1963, Henry E. Whitney
did execute, acknowledge and deliver to the City of Lubbock, of the County
of Lubbock, State of Texas, a certain deed of trust, recorded in the Deed
of Trust Records of Lubbock County, Texas, Volume 396, Page 697, on
the following described real estate lying and being in the County of Lub-
bock in said State of Texas, to-wit: Lot 6, Block 6, Suburban Homes
Addition to the City of Lubbock, Lubbock County, Texas, to secure the
prompt payment of the promissory vendor's lien executed by the said
Henry E. Whitney and payable to the order of the City of Lubbock as
follows:
An installment vendor's lien note in the amount of ONE THOUSAND
FIVE HUNDRED AND NO/100($1,500. 00) DOLLARS dated November 14,
1963, payable to the City of Lubbock, Texas, in three (3)annual installments
of FIVE HUNDRED AND N0/100 ($500. 00)DOLLARS each, together with
interest of six per cent (6%) per annum on the unpaid balance; with the
first being due on November 14, 1964. and an equal amount being payable
on November 14, of each year thereafter until the principal and interest
is paid in full; and,
WHEREAS, said note with accrued interest thereon has been fully
paid to the City of Lubbock, the legal and equitable holder and owner of
such notes; and,
NOW THEREFORE, KNOW ALL MEN BY THESE PRESENTS:
THAT the City of Lubbock, meting by and through its heretofore
duly authorized officer, of Lubbock County, State of Texas, in consideration
of the premises and of the full and final payment of the said promissory ven-
dor's lien note together with all interest due thereon; the receipt of which is
hereby acknowledged, has this day, and does by these presents, release,
discharge and quitclaim unto the said Henry F. Whitney, his heirs or assigns
all the right, title, interest and estate in and to the property above described,
which it has or may be entitled to by virtue of said deed of trust and its ven-
dor's lien, and does hereby declare the same fully released and discharged
from any and all liens created by virtue of said note, vendor's lien and deed
of trust above mentioned.
