HomeMy WebLinkAboutResolution - 102264G - Land Acquisition - Annie Hall - Section 3 Block B - 10_22_1964 1 U Z2G0� R E S O L U T I O N WHEREAS, the City Council of the City of Lubbock has heretofore determined and now finds that due to increased demands on the sanitary sewer system in the 10- Lti City of Lubbock, it is necessary to construct additional sanitary sewer trunk mains; and, WHEREAS, to accomplish this purpose, it is necessary to acquire, for right of way purposes, a sanitary sewer line easement through the land hereafter describec and, WHEREAS, Annie Hall, a widow, owns said land, and the value and total damages to the owner 66r the sanitary sewer easement through said land have been appraised in the amount of $100.00 and the Council finds said amount to be fair and equitable; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK,. THAT a sanitary sewer line easement through the following described Land situated in the City of Lubbock, Lubbock County, Texas, be acquired by the City of Lubbock for the purpose of constructing and maintaining a sanitary sewer line known and designated as Oak Avenue Lift Station Trunk Sewer Line which land is more particularly described as follows: I. Permanent easement A parcel of land out of Section 3, Block B, Lubbock County, Texas, being a 20.0 foot wide strip of land extending 10.0 feet, measured at right angles, on each side of the following described center line. BEGINNING at a point in the West line of a tract of land conveyed to Mrs. Annie Hall, a widow, by deed recorded in Volume 951, Page 103, Lubbock County Deed Records said point being 88.7 feet North of the Southwest corner of said tract; THENCE Northeasterly a distance of 95.7 feet, more or less, to a point in the West line of a tract of land conveyed by Mrs. Annie Hall, a widow, to Annie Davis and husband, Henry L. Davis by deed recorded in Volume 952, Page 356, Lubbock County Deed Records, said point being 95.4 feet North of the Southwest corner of said Davis tract of land. II. Temporary working easement A strip of land 60.0 feet in width being 30.0 feet, measured at right angles, on each side of the center line above describedsaid temporary working easement to automatically expire six months after the line is completely installed and covered up. THAT the owners of said land be offered, through the Right of Way Department, the amount appraised as the value and total damages for the sanitary sewer line easement through said land for the purposes herein stated, for the use and benefit of the City of Lubbock, and unless accepted forthwith the City Attorney is hereby authorized and instructed to institute condemnation proceedings for and on behalf of the City of Lubbock to acquire the sanitary sewer line easement through said land as hereinabove described.
