Maddox - Maddox Addition - 07_30_1964 �FOS:jLm 015*1 E-7-64 RESOLUTION r^ BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock be and is hereby authorized and directed to execute for and on behalf of the City of Lubbock a Corrected Warranty Deed attached herewith which shall be spread upon the minutes of the Council and as spread upon the minutes of this Council shall constitute and be a part of 1 this Resolution as if fully copied herein in detail. Senter, Jr., ty Attorney CORnC_TRV DEX—D 'THE STATE OF TEXAS � COUNTY OF LUBBOCK X WHEREAS, by warranty deed dated February 27, 1964, recorded in Volume 961, Page 529, of the deed records of Lubbock County, Texas, the City of Lubbock conveyed to W. A. Maddox the following de- scribed real estate, situated in Lubbock County, Texas, to-wits All of Lots Rose Eighteen (16) and Nineteen (19), Block No. Thirty-five (35), Maddox Addition to the City of Lubbock, Lubbock County, Texas, SAVE AND EXCEPT that there was reserved to the grantor in said deed, its successors and assigns, a permanent and perpetual easement which includes the right at any time to ingress and egresss to locate, drill, maintain, and improve seater well sitest and to locate, lay, maintain and improve pipelines, electric lines, and any other apparatus or device necessary to the operation cf water wells on a parcel of land off the north side of Lots 16 and 19, Block 35, Maddox Addition to the City of Lubbock, more particularly described as follows, BEGINNING at the Northwest Corner of said Block 35, Maddox Addition, said point being the Northwest Corner of Lot 19, said Maddox Addition; THENCE South 70 feet to a points THENCE East 50 feet to a points THENCE North 70 feet to a pointy w THENCE nest 50 feet to they POINT OF BEGINNING; and.. WHEREAS, said deed was in error in conveying said property to W. A. Maddox, in that the consideration therefor was paid by Maddox Investment Company, and it was the purpose and intent of the parties that said properties should be conveyed to Maddox Investment Company, and the conveyance to W. A. Maddox instead of to Maddox Investment Company was a result of an error on the part of the scriveners , NOW. THEREFORE, in consideration of the premises and for the purpose of correcting the error aforesaid, and in con- sideration of the sine of FOUR HUNDRED FIFTY ($450.00) DOLLARS cash to the City of Lubbock in hand paid by Maddox Investment Company, receipt of which is hereby acknowledged, the under- signed, City of Lubbock, a Hoene Rule Municipal Corporation, has granted, sold and conveyed, and by these presents does grant, sell and convey unto Maddox Investment Company, a corporation, the following described real estate, situated in Lubbock County, Texas, to-wits All of Lots 16 and 19, Block 35, Maddox Addition to the City of Lubbock, Lubbock County, Texas* subject to the reservation herein described. TO HAVE AND TO SOLD the above described property and premises, together with ail and singular the rights and appurtenances there- to in anywise belonging, unto the said grantee, its successors and assigns, against every person whomsoever lawfully claiming or to claim the same or any part thereof, save and except there is here- by reserved unto the grantor. its successors and assigns a permanent and perpetual casement Mich includes the right at any time to ingress and egreset to locate, drill, maintain and improve water well sites and to locate, lay. maintain, and improve pipe lines, electric lines and any other apparatus or device necessary to the operation of water wells on a parcel of land off the North side of Lots 18 and 19, block 35, Maddox Addition to the City of Lubbock, more particularly described as followss BEtiXMING at the Northwest corner of said Block 35, Maddox Addition, said point being the Northwest corner Of Lot 19, said Maddox Additiont THENCE South 70 feet to a points THENCE East 50 feet to a pointl THENCE North 70 feet to a points THENCE incest 50 feet to the POINT OF BEGINNING. This deed is given in lieu and instead of said deeds dated February 27, 1964, to correct the error above recited. i EXECUTED This 30th day of July A. D., 1964.
