RESOLUTION
WHEREAS, it is hereby deemed in the interest of the public health,
safety, and general welfare of the citizens of the City of Lubbock to enter
an Agreement between said City and the State Highway and Public Transporta-
tion Department of the State of Texas concerning highway traffic signals
and reduced speed school zone beacons in areas recently annexed to the City
of Lubbock; NOW THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the Mayor of the City of Lubbock (herein called
"City") is hereby authorized and directed to execute an Agreement to be
entered into by and between said City and the State Highway and Public
Transportation Department of the State of Texas (herein called "State")
concerning two traffic signal systems located in areas recently annexed to
the City, located at the intersection of State Highway 114 with Spur 309
and the reduced Speed School Zone beacons on F.M. 2255 (4th Street) in the
school area adjacent to Reese Village, attached herewith, which shall be
spread upon the minutes of the Council and as spread upon the minutes of
this Council shall constitute and be a part of this Resolution as if fully
copied herein in detail.
SECTION 2. THAT the continued existence, use, operation, and main-
tenance of the highway traffic signals being left by the State (same being
described in the Agreement hereinabove referred to) is hereby authorized by
the City by passage of this Resolution.

COUNTY OF TRAVIS
This AGREE I', dated this 28th day of June , 1985 by
and between the State of Texas, hereinafter called the "State," Party of
the First Part; and the City of Lubbock, Lubbock County, Texas, acting by
and through its duly authorized officers under an Ordinance/Resolution,
passed the 28th day of June , 19 85 , hereinafter
called the "City," Party of the Second Part, is made to became effective
when fully executed by both parties.
WITNESSETH
WHEREAS, there is (are) (a) highway traffic signal(s) in place at the
location(s) Shown on Exhibit 1, attached hereto and made a part hereof, said
highway traffic signal(s) was (were) not within corporate limits of the City:
and
WHEREAS,said location(s) is (are) now within the corporate limits of the
City; and
TnHERE',AS, It is not the policy of the State to install, operate, or main-
tain highway traffic signals inside the corporate limits of cities of 15,000
population and over (latest Federal Cenus), except on expressway type
facilities; and
MMREAS, the City, which now exceeds 15,000 population, has requested the
State to leave the highway traffic signal(s) in place at the location(s) shown
on Exhibit 1 and has authorized the continued existence, use, operation, and
maintenance of the highway traffic signals by Ordinance/Resolution, passed on
the 28th day of June 19 85

Now, therfore, in consideration of the premises and of the mutual cove-
nants and agreements of the parties hereto to be by the, respectively kept and
performed, as hereinafter set forth, it is agreed as follows:
1. The State will leave the highway traffic signal(s) in place at the
location(s) shown on Exhibit 1. The plans for the highway traffic signal
installation(s) are attached hereto, marked Exhibit 2, and made a part hereof.
2. The City will operate and maintain the signal(s) at their expense.
3. The City will pay all paver costs for operating the signal(s).
4. The City will obtain written approval of the State Department of
Highways and Public Transportation before making any changes in the design of
operation and timing of the signal(s) or before removing any part of the
installation(s).
5. The City will return any and all parts of said highway traffic signal
installation(s) to the State should it (they) be removed by the City for any
reason other than for installation on a State or Federal numbered highway route
at a location approved by the State.
6. In the event the signal installation(s) covered by this Agreement
become unnecessary or is (are) removed for any reason, this Agreement shall ter-
minate.
7. To the extent permitted by law, the City shall indemnify and save
harmless the State, its agents or employees, from all suits, actions or claims
and from, all liability and damages for any and all injuries or damages sustained
by any person or property in consequence of any neglect in the performance, or
failure of performance of the City, its agents and Employees under this Agreement.

8. The State will not incur any financial obilgation to the City as a
result of this Agreement.

IN TESTIMONY WHEREOF, the parties hereto have caused these pre-
sents to be executed in triplicate on the dates shown hereinbelow.
