RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock be and is hereby authorized and
directed to execute for and on behalf of the City of Lubbock a Quit Claim Deed to
3 C. N. Hodges attached herewith which shall be spread upon the minutes of the
Council and as spread upon the minutes of this Council shall constitute and be a par
/'�• of this Resolution as if fully copied herein in detail.
Passed by the City Council this 16th day of July 1964.

KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF LUBBOCK s
THAT the City of Lubbock, a Home Rule Municipality of the
County of Lubbock and State of Texas, for and in consideration of the
sum of ONE AND NO/100 ($1.00) DOLLARS and other good and valuable con-
sideration to it in hand paid by FIRST NATIONAL BANK AT LUBBOCK, TEXAS,
AD14INISTRATOR WITH THE WILL ANNEXED OF THE ESTATE OF C. N. HODGES, DE-
CEASED and THE FIRST NATIONAL BANK OF FORT WORTH, TEXAS, and FOSTER
HOWELL, CO-ADMINISTRATORS WITH THE WILL ANNEXED OF THE ESTATE OF LINNIE
JANE HODGES, DECEASED, of the County of Lubbock and State of Texas, the
receipt of which is hereby acknowledged, do, by these presents, BARGAIN
SELL, RELEASE and FOREVER QUIT CLAIM unto the said FIRST NATIONAL BANK
AT LUBBOCK, TEXAS, ADMINISTRATOR WITH THE WILL ANNEXED OF THE ESTATE
OF C. •N. HODGES, DECEASED and THE FIRST NATIONAL BANK OF FORT WORTH,
TEXAS and FOSTER HOWELL, CO-ADMINISTRATORS WITH THE WILL ANNEXED OF
THE ESTATE OF LINNIE JANE HODGES, DECEASED, of the City of Lubbock,
all its right title and interest in and to that certain tract or parcel
of land lying in the County of Lubbock and State of Texas, described
as follows, to-wit:
A parcel of land out of Section 2, Block E, Lubbock
County, Texas, more fully described by metes and bounds
as follows:
BEGINNING at a point 1015.0 feet South and 30.0 feet
East of the Northwest corner of Section 2, Block E;
THENCE South 79.97 feet to a point of curve;
THENCE on a curve to the left having a radius of
132.43 feet a distance of 95.56 feet to a point in
the Northeast line of Avenue 0;
JTHENCE North 41022' West a distance of 95.39 feet;
THENCE North 102.66 feet to a point, said point being
1 in the South line of the new alignment of 53rd Street;
THENCE Southeasterly and East on a curve to the left
having a radius of 70.0 feet a distance of 31.19 feet
to the POINT OF BEGINNING.
From this conveyance, there is expressly reserved and retained
to the City of Lubbock for the benefit and use of the public, the City
of Lubbock and all public utilities who are franchised or may be fran-
chised by the City of Lubbock to use the streets and alleys of the City
of Lubbock, a perpetual and permanent easement which includes, but is
not limited to the right to construct, reconstruct, repair and perpet-
ually maintain any and all types of water lines, sewer lines, gas lines,
and any other type of public utility equipment, whether named herein or
not, and whether now constructed on the premises herein conveyed or to
be constructed in the future, together with the right of ingress, egress
and regress for such purposes in, on, under, above, through, and across
all of such property described.
TO HAVE AND TO HOLD the said premises, together with all and
singular the rights, privileges and appurtenances thereto in any manner
belonging unto the said FIRST NATIONAL BANK AT LUBBOCK, TEXAS, ADMINI-
STRATOR WITH THE WILL ANNEXED OF THE ESTATE OF C. N. HODGES, DECEASED
and THE FIRST NATIONAL BANK OFFORT WORTH, TEXAS, and FOSTER HOWELL.
CO-ADMINISTRATORS WITH THE WILL ANNEXED OF THE ESTATE OF LINNIE JANE
HODGES, DECEASED, their successors and assigns, nor any person or
persons claiming under it shall, at any time hereafter, have, claim or
demand any right to title to the aforesaid premises or appurtenances,
or any part thereof.

said County, Texas, on this day personally appeared MAX TIDMORE, known
to me to be the person whose name is subscribed to the foregoing instru-
ment and acknowledged to me that he executed the same as the act and
deed of the City of Lubbock and as Mayor for the purposes and consider-
ation therein expressed, and in the capacity therein stated.
