RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: a
THAT the Mayor of the City of Lubbock BE and is hereby authorized and
directed to execute for and on behalf of the City of Lubbock a Contract by
and between City of Lubbock and Hunter Construction Company for Civic
Center bridge and step repair, attached herewith, which shall be spread
upon the minutes of the Council and as spread upon the minutes of this
Council shall constitute and be a part of this Resolution as if fully
copied herein in detail.
Passed by the City Council this 23rd day of May , 1985.

WITNESSETH: That for and in consideration of the payments and
agreements hereinafter mentioned, to be made and performed by the
OWNER and under the conditions expressed in the bond bearing even
date herewith (if any) the CONTRACTOR hereby agrees with OWNER to
commence and complete the construct•3.on of certain improvements
described as follows:
Civic Center Bridge and Step Repair — Base Bid @ $21,987.00 plus Alternate No. 1
@ $4,197.00 as per City of Lubbock Bid No. 8512
and all extra work in connection therewith, under the terms as
stated in the contract documents and at his (or their) own proper
cost and expense to furnish all materials, supplies, machinery,
equipment, tools, superintendence, labor, insurance and other
accessories and services necessary to complete the said construction
in accordance with the contract documents as defined in the General
Condition of Agreement.
The CONTRACTOR hereby agrees to commence work within ten days
after the date written notice to do so shall have been given to him
and to substantially complete same within the time specified in the
contract documents•
The OWNER agrees to pay the CONTRACTOR in current funds for the
performance of the contract in accordance with the proposal s.
submitted therefore, subject to additions and deductions, as
provided in the contract documents and to make payment on account
thereof as provided therein.

"Article VI — Execution of Obligations and Appointment of Attorney -in -Fact

other obligatory instruments of like nature. Such attorneys -in -fact, subject to the limitations set forth in their respective certificates
of authority shall have full power to bind the Company by their signature and execution of any such instruments and to attach the
seal of the Company thereto. The President or any Vice President or the Board of Directors may at any time revoke all power and
authority previously given to any attorney -in -fact."
This Power of Attorney is signed and sealed by facsimile under and by the authority of the following Resolution adopted by the
Board of Directors of the Company at a meeting duly called and held on the 11th day of November, 1966:
"Resolved, that the signature of the President or a Vice President and the seal of the Company may be affixed by facsimile on
any power of attorney granted pursuant to Section 2 of Article VI of the By -Laws, and the signature of the Secretary or an Assistant
Secretary and the seal of the Company may be affixed by facsimile to any certificate of any such power and any such power or cer-
tificate bearing such facsimile signature and seal shall be valid and binding on the Company. Any such power so executed and
sealed and certified by certificate so executed and sealed shall, with respect to any bond or undertaking to which it is attached,
continue to be valid and binding on the Company."
