City Attorney CHANGE ORDER NO. 2 TO CONTRACTS "A" AND "B" 2ND 1984 MAINTENANCE PROGRAM Gentlemen: WHEREAS, it is necessary to make changes in the specifications, plans and list of streets to be paved with a two -course asphalt surface and streets to be reconstructed with nine (9) inches of black base and streets to be reconstructed using the existing materials. The reason for this change is: 1. The work on 6th Street from University Avenue to Boston Avenue is deleted. 2. On 50th Street there is an eight (8) inch high pressure gas line that is nine inches deep causing delay to the Contrac- tor until Energas lowers the line. 3. The two -course asphalt surface contract could not be com- pleted because of excessive patching and inability to secure patching materials as needed. WHEREAS, the City Council has approved the Maintenance improvements as listed in the specifications on May 24, 1984. WHEREAS, the Contractor herein agrees to the following changes: 1. The re -construction on University Avenue from 66th Street to Loop 289 R. O. W. line south of 70th Street must be completed (black base) by March 2, 1985 and the 1-1/2 inches of type "C" hot -mix must be completed not later than fourteen (14) days after the black base is completed (weather permitting). If the black base is not completed on March 2, 1985, the liquidated damages of $500.00 per day will apply until the work is completed. 2. The re -construction on Quaker Avenue from 50th Street to 51st Street must be completed by April 1, including placing of the 1-1/2 inches of hot -mix surface ( weather permitting) . After April 1, 1985, the liquidated damages of $500.00 per day, as stated above,will apply until the work is completed. 3. The Black Base construction on 50th Street (from Avenue H to 100' East of Avenue L) will be started as soon as the Gas Company lowers the gas line, and the two -course asphalt surface may be applied between June 15, 1985 and July 15, 1985 and must be completed by July 31, 1985. After July 31, 1985, the liquidated damages of $500.00 per day, as stated above, will apply until the work is completed. Change Order No. 2 Contracts A & B - 1984 Maintenance Program Page -2 4. The two -course asphalt surface and patching may be started anytime between June 15, 1985 and July 15, 1985, but must be completed by July 31,1985. After July 31,1985,the liquidated damages of $500.00 per day,as stated above, will apply until the work is completed. THIS AGREEMENT WITNESSETH: In consideration of the mutual advantages gained, the owner and the Contractor agree to the change herein and in the revised plans. The contractor agrees to proceed with construction and to adhere to applicable specifications under the direction of the Engineer. Furthermore, the parties agree that the original contract between the Owner and the Contractor shall be modified to the extent herein indicated including one (1) attachemant. University Avenue 66th to Loop 289 R. W. O. line south of 70th Street. After the existing materials are removed and the sub -grade is completed and inspected, then the contractor will be required to lay this area immediately. If black base cannot be layed immediately, then the contractor will not be allowed to remove the existing pavement and base until the owner is assured a complete cycle of the reconstruction. 2. Quaker Avenue from 50th Street to 51st Street. Only one-half (1/2) of this street will be closed for construction. On the other one-half (1/2), two-way traffic will be maintained at all times. 3. Temperature Control. See Page III-5, Item 5-D Contract "B" Specifications.
